6: Promotion Period Start Date & Time
The Promotion opens on Tuesday 25th October 2022, at 15:00PM (AEDT).
The Promoter reserves the right to tease the promotion prior to the competition start date.
7. Promotion Period Close Date & Time
The Promotion concludes Thursday 17th November 2022, at 12:00pm. (AEDT)
The Promoter reserves the right to:
(i) amend the close date at its absolute discretion including to
close the Promotion within the Promotion Period.
(ii) terminate the Promotion subject to any direction from a
regulatory authority.
8. Entry Restrictions
a) Entrants must be over the age of 5 to enter the competition. However, all entrants under the age of 18 must have permission from their parent or guardian prior to entry to be eligible for the competition. Entrants may be required to provide a signed consent form signed by their parent or legal guardian, consenting to their participation in the competition.
(a) Entrants (or their parent or legal guardian) may enter each Promotion more than once, however, only one prize can be won per person.
(b) Promotions are not open to any person, including Australian residents, entering the Promotion from outside of Australia.
(c) Entrants (or their parent or legal guardian) must nominate someone they would like to participate in a challenge with and describe an item that they would like to win for Christmas. The entrant must have gained permission from their nominated person (or their parent or legal guardian) for their personal details to be shared with The Promoter.
(d) Entrants (or a parent or legal guardian) acknowledge that they must be contactable by the Promoter to be successful.
Entrants, or parents or legal guardians unable to be contacted in accordance with these terms for any reason will forfeit their prize/opportunity.
(e) Entrants, nominated persons, parent or legal guardians who provide incorrect, misleading or fraudulent information are ineligible in the promotions and all entries of an entrant who is deemed by the Promoter to have provided incorrect or misleading information may, at the discretion of the Promoter be deemed invalid.
(f) If for any technical reason, the phone line drops out, or they are inaudible or they are or they are unreachable for any reason (including without limitation any technical or operator error), the entrant will not be awarded with a prize.
(g) The entrants and nominated persons must be available at a time advised by the promoter, between Monday 31st October and Thursday 17th November 2022. For entrants and/or nominated persons under the age of 18, a parent or legal guardian must be present.
(h) The entrants and nominated persons must attend an event in Melbourne city. If the entrants and nominated person is unable to attend the time and day specified by the promoter, they forfeit the major prize.
(i) Entrants, their nominated person, or parents/legal guardians may be required to sign a legal indemnity form prior to accepting any prizes.
9. How to enter
Online registration for an activity:
During the Promotion Period:
(a) Listeners will be invited via Station on-air commercials to visit the Station Website and complete the online entry form. The form includes providing their contact details, and nominating a person that they would like to participate in a Christmas challenge with. The entrant must also enter a Christmas product that they would like to win.
i. For the avoidance of doubt, if entrants, and nominated persons are successful at winning, they may not be given their entered prize, but an alternative prize determined by The Promoter and subject to availability. This may not be to the same value or increased value of the original entered prize. The Promoter’s decision is final and no further communication will be entered into.
(b) Over the Registration period, Monday 31st October to Thursday 17th November 2022 (subject to change at the Promoter’s discretion), the Promoter will call a selection of entrants and/or their nominated persons. They may be put to air and may be required to share information about themselves/or nominated person on air.
(c) The Station may contact entrants to ask further questions about their entry. If entrants receive a call or are put to air this does not mean that they are the deemed winner.
(d) The Promoter will select up to five (5) entries over the contesting period that it deems to be the “best” (in its absolute discretion) based on the Judging Criteria from all valid entries received within the time period specified to receive the opportunity to compete in the Challenge.
(e) The Station may use the entrants and their stories live on air in connection with the Promotion over the specified Competition Period. For example, the Promoter in its absolute discretion may invite entrants to air to talk about their entry. If an entrant is invited to speak on air this does not deem him/her as a winner. The Promoter in its absolute discretion has the right to share entrants’ stories online and via its social media platforms.
(f) If the Entrant does not answer their phone within the time specified (as determined by the Promoter), they will forfeit their entry and the announcers will call the next entrant.
(g) A person that is put to air, or determined as an on-air prize winner cannot pass the telephone call on to anyone else, and should this occur, any person that is on air or has been passed the phone in this capacity will not be eligible for a prize, at the discretion of the Promoter.
(h) The Promoter reserves the right in its absolute discretion to refrain from broadcasting any call or event recording.
(i) The Promoter may, in its sole and absolute discretion, call entrants to deem their suitability for radio. For avoidance of doubt this does not mean they have been deemed a winner or awarded the prize.
10. Limitation on entries
Entrants may enter each Promotion as many times as they wish, however Entrants may only win one (1) prize each for their nominated person.
11. Challenges
(a) The up to five (5) selected entrants and their nominated person will be invited to attend a Christmas Event (the time and date to be determined by the Promoter) to take part in the Challenge for the opportunity to win a prize.
(b) The Challenge may involve various physical activities to test the challenger’s agility and speed for a length of time as specified by the Promoter. If the entrant and/or nominated person is under the age of 18, their parent or legal guardian will be contacted, and must be present at the Challenge, and consent to the activity.
(c) Parents or legal guardians of any entrants or nominated persons under the age of 15, will be required to provide personal details about the children, to complete Child Employment permits through the Victoria Wage inspectorate. If the parent or legal guardian cannot provide information requested by The Promoter, they will forfeit the competition.
(d) Parents or legal guardians of any entrants or nominated persons under the age of 15, will need to complete and signed Child Employment consent forms provided by the Victoria Wage Inspectorate.
(e) If the challenger satisfactorily completes the challenge within the time specified and in accordance with any other criteria for success as specified by the Station, the challenger will win a prize. The entrants and their nominated persons must always follow the instructions of the promoter.
(f) The specific rules of the Challenge will be outlined to the entrants, nominated persons, and parents or legal guardians, onsite at the event. The promoter reserves the right to amend the rules throughout the challenges.
(g) The entrant and their nominated prize will be given an allocated prize to compete for, at the complete discretion of The Promoter. The Promoters decision is final.
(h) The Promoter will determine if the entrants and nominated persons have completed the challenges successfully, in order to be deemed a winner.
(i) Challengers will be required to adhere to competition rules and regulations as specified by the Promoter prior to the challenge commencement. Rules may or may not be stipulated on air by the Promoter, at their absolute discretion.
(j) The Promoter, at their absolute discretion, reserves the right to introduce additional challenges and/or vary up the rules, as stipulated on air. For example, at any time during the challenge the announcer may give the entrant additional challenges or bribes. Examples including, but not limited to: A bonus round/double or nothing.
(k) Should the challenger refuse, or fail to satisfactorily complete the challenge within the time specified, they will forgo any prize and the Station will not be required to conduct the challenge again.
(l) The entrants, nominated persons and parents or legal guardians must be available at the time and location determined by the promoter for the event, between Monday 31st October 2022 and Thursday 17th October 2022.
(m) Additional requests may be asked from the entrants and nominated persons at the Promoter’s discretion. If these requests are not accepted by the entrant, nominated persons or parent or legal guardians, their prize will be forfeited.
(n) The Station’s decision as to the result of the challenge is final and no correspondence will be entered into.
12. Judging Criteria During the registration and Promotion period, each valid entry will be individually judged (by representatives of the Promoter) based on among other things, creativity, humour, suitability for radio. 13. Draw Details N/A
14: Prize Details
There are up to (5) five major prizes to be won as follows:
• Each Major Prize will consist of two items selected at the
discretion of the promoter; one prize for the entrant and one prize for their nominated to the total value of up to $2,000 AUD (excl GST);
The Promoter reserves the right to also give the entrant the value of their prize as a voucher.
If an Entrant is deemed a winner, they will receive one (1) prize only.
Prizes awarded are subject to availability and are at the complete discretion of the Promoter.
All prizes are non-transferable. Any prize that is found to be for sale or on-sold will be cancelled and will not be reissued.
No refund or exchange will be given for any prize.
Entrant’s and their nominated person are responsible for transport and costs to and from the challenge event.

16: Winner Notification
The entrant and prize winner will be notified in person by the promoter if they have been successful in winning a prize. The prize winner will then be contacted after winning via phone or email to organise the prize.
