21st Birthday Giveaway - Terms and Conditions
Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter is M&D Nikitaras Pty Ltd (trading as Hill Street), 2 Melville Street, Hobart, TAS 7000 (“Promoter”).
Entries into the promotion open at 7.00am on Wednesday 19 October 2022 and close at 5.00pm on Monday 7 November 2022 (“Promotional Period”).
To be eligible to enter, individuals must join The Happiness Club or login to their existing Hill Street loyalty account at hillstreetgrocer.com/happiness during the Promotional Period.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions, tampered with the entry process or engaged in any unlawful or improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Entrants under 18 years of age must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, de facto spouse, child or step-child, parent, step-parent, sibling or step-sibling.
This promotion is not sponsored, endorsed or administered by, or associated with Facebook, Instagram or any other social media used throughout the competition. Except for any liability that cannot be excluded, including the Promoter’s liability in relation to the consumer guarantees under the Australian Consumer Law, the Promoter and any associated agencies, related companies, employees and contractors shall not be responsible or liable for any financial costs, misadventure, tax implications, accident, injury, damage, death, loss, claim or expense that may occur to the entrant or any persons related, as a result of the competition or in any connection with an entrant’s entry into the competition and/or in connection with any element of the prize.
The draw will take place at 2 Melville Street, Hobart, TAS 7000 on Thursday 10 November 2022 at 9.00am. In the event that, for any reason, the winner does not (or is unable to) redeem the prize or any element of the prize then the prize will be forfeited by the winner and no substitute or cash will be awarded in lieu of that prize or of that element of the prize.
The Promoter’s decision is final and no correspondence will be entered into.
The winner of the Major Prize will have the choice of a $21,000 Greek holiday, or $21,000 groceries supplied by Hill Street, or $11,000 groceries supplied by Hill Street and $10,000 fuel (“Major Prize”).
Nine runners-up will each receive 10,000 The Happiness Club points. (“Minor Prize”).
Additional spot prizes will be drawn every day of the promotional period. Each day one winner will receive either 10,000 bonus The Happiness Club points, or a $100 fuel voucher (“Spot Prizes”).
The total prize pool value is $26,100.
Major prize is subject to the terms and conditions of individual service providers.
As a condition of accepting the prize, the winners of the Major Prize, Minor Prize and Spot Prizes must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion including but not limited to a legal release and indemnity form.
Prizes, or unused portion, are not transferable and cannot be taken as cash or re-sold unless expressly stated by the Promoter.
The Promoter reserves the right to determine the identity of the prize winners at their discretion, if there is any dispute as to the identity of an entrant or winner.
If the winner of a prize is under the age of 18 years, the Prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed, stocked and/or supplied by the Promoter.
By entering the promotion, entrants acknowledge and agree that the Promoter will collect, store and use all personal information provided for use in connection with this promotion and for any promotional, marketing, publicity and social media purposes without notice or compensation. The Promoter may disclose the entrant’s personal information to third parties, agencies and prize suppliers, some of which may be located outside of Australia (Greece), for these and related business purpose including to assist in conducting this competition.
The Promoter may communicate with entrants about its products and services via email, SMS, mail or telephone.
Any personal information the Promoter collects about the entrant will be handled in accordance with the Privacy Act 1988 (Cth), Australian Privacy Principles and the Promoter’s Privacy policy which is available at
