4. Eligible Entrants
4.1 The Promotion is only open to individuals who:
(a) are Australian residents aged 18 years or over; and
(b) are not otherwise ineligible or excluded under these Terms and Conditions,
4.2 Employees (and their immediate families) of the Promoter, and those of the agencies and suppliers associated with this Promotion, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. How to enter
5.1 To enter, Eligible Entrants must complete the following steps during the Promotional Period:
(a) Purchase 30 litres or more of any Shell fuel (excluding LPG and AdBlue and excluding purchases made with Shell Card, Fleet Card, Motorcharge or Motorpass) in a single transaction from a participating “Shell” or “Shell Coles Express” service station in Australia. For participating service stations, see “Participates in Viva Energy promotions” at shell.com.au/motorists/fuel-finder.
(b) Retain the original or a copy of the purchase receipt issued by the participating service station on payment as proof of purchase (with the Eligible Entrant being responsibile for requesting a purchase receipt if one is not provided at the time of purchase). If the Eligible Entrant is unable to provide evidence of a purchase transaction to the Promoter’s reasonable satisfaction through the provision of the purchase receipt, the Promoter may determine the Eligible Entrant’s entry to be invalid (thereby forfeiting any rights to claim a Prize).
(c) Visit www.shell.com.au/unbeatable
and follow the prompts to the Promotion entry page and complete the online entry form, including by (without limitation):
inputting the requested details (including their full name, email address, phone number and the full purchase receipt number and site number, as shown on the purchase receipt);
inputting the type of Shell fuel purchased;
uploading a copy of the purchase receipt; and
submiting the fully completed online entry form.
5.3 As part of the entry process, Eligible Entrants must consent to receiving communications from the Promoter regarding offers, promotions, goods and services and other promotional materials.
5.4 Multiple entries during the Promotional Period are permitted, subject to the following conditions:
only one (1) entry permitted per purchase transaction (regardless of how many litres of Shell fuel over 30 litres is purchased in that transaction); and
each entry must be submitted separately and in accordance with all entry requirements.
6. Entry procedures
6.1 Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the Eligible Entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
6.2 The Promoter has no control over the communications networks that may be used to enter the Promotion and is not liable for any problems associated with them due to network traffic congestion, technical malfunction or otherwise. For clarity, the Promoter is not liable for any consequences of user error including (without limitation) costs incurred. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. Incomplete or indecipherable entries will be deemed invalid.
6.3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, contact details and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
6.4 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
6.5 The Promoter’s decision is final and no correspondence will be entered into.
7. The Draw
7.1 The Draw will take place at Anisimoff Legal, Suite 5/210 Central Coast Highway, Erina NSW 2250 at 10:00am AEDST on 08/03/2023 in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified by email within two (2) business days after the draw and their names will be published online at http://shell.com.au/winners
7.2 The first valid entry drawn will win the major prize valued at $56,950 consisting of the following:
4 x General Admin tickets to the 2023 World Supercross Championships in Melbourne, VIC scheduled to take place in November 2023 including a behind the scenes tour for each person and 4x merchandise packs.
4 x tickets to the 2023 Toyota AFL Grand Final (scheduled to be held in Melbourne, VIC in September 2023).
4 x tickets to the 2023 Queensland Maroons State of Origin Game in Brisbane, QLD scheduled to take place in June 2023.
4 x tickets to 2023 Bathurst 1000 scheduled to take place in Bathurst, NSW in October 2023.
4 x tickets to 2023 Women’s Queensland Rugby League Maroons State of Origin Game scheduled to take place in June 2023.
1x AUD$20,000 Flight Centre voucher to be used towards travel and/or accommodation required to attend each of the above events; and
1x $1,000 in Shell Coles Express Gift Card.
Unless otherwise specified, the major prize includes tickets to each listed event only and the winner and their companion/s will be responsible for all travel and accommodation costs in getting to and from each event. The Promoter has included a Flight Centre voucher to the value of $20,000 to assist the winner and their companion/s with getting to and from each listed event, however it is up to the winner to make all travel arrangements. Any ancillary costs associated with redeeming the Flight Centre voucher are not included. Any unused balance of the Flight Centre voucher will not be awarded as cash. Redemption of the Flight Centre voucher is subject to any terms and conditions of the issuer including those specified on the Flight Centre voucher.
All tickets that form part of the Prize are subject to the relevant event venue/s and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.
7.3 The next six (6) valid entry drawn will each win a minor prize of a $1,000 Shell Coles Express Gift Card.
7.4 Each winner of a Prize must be able to provide the Promoter with a copy of the purchase receipt used to enter the Promotion in order to claim their Prize. Purchase receipt(s) must clearly specify that the purchase was made at a participating service station during the Promotional Period but prior to entry.
7.5 No part or the whole of the value of a Prize can be transferred to any other person or exchanged for cash. Prizes are subject to the standard terms and conditions of individual Prize and service providers.
7.6 To the fullest extent permitted by law, the Promoter is not liable for failure by a winner or any companion (where relevant) to use or take the benefit of any part or the whole of a Prize, including (without limitation) where that failure arises as a direct or indirect result of any fraud, theft, illness, loss, act or omission by or of a winner/com apnion or any third party, or from any act of God.
, as well as any terms specified on the Shell Coles Express Gift Card itself.
7.8 Redemption and use of each Prize, and entry into, and participation in, all activites forming part of a Prize, are subject to the terms and conditions of the Prize issuer and any terms shown on any ticket forming part of the Prize.
7.9 As a condition of accepting a Prize, the winner and companion/s where relevant must sign any legal documentation as and in the form reasonably required by the Promoter and/or Prize issuers, including but not limited to a legal release and indemnity form.
8. The Prizes
8.1 Each of the prizes described in section 7 (“The Draw”) of these Terms and Conditions is a “Prize” for the purposes of these Terms and Conditions.
8.2 Any ancillary costs associated with redeeming vouchers or gift cards or any other benefit forming part of a Prize are not included in the Prize. Any unused balance of these Prizes will not be awarded as cash.
8.3 The total prize pool value for this Promotion is $62,950. Prizes, or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. Winners cannot swap or choose their Prize.
8.4 If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or similar specification (which, for the purposes of these Terms and Conditions, is also a Prize), subject to any legislative restrictions or directions from a relevant regulatory authority.
8.5 If for any reason, a winner does not arrange with the Promoter (or its agencies) for the receipt of their Prize (or any element of their Prize) by the date that falls one (1) day before the redraw, then their Prize (or that element of their Prize) will be deemed to be unclaimed.
8.6 A redraw for any unclaimed Prizes may take place on Tuesday, 11 April 2023 at the same time and place as the original draw, subject to any legislative restrictions or directions from a relevant regulatory authority. Winners, if any, will be notified by email within two (2) business days after the redraw and their names will be published online at http://shell.com.au/winners

10 General terms
10.1 Any person who claims a Prize agrees to and must participate in, and co-operate with, as reasonably required by the Promoter (or its agencies) all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
10.2 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any legislative restrictions or written directions from a relevant regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
10.3 Any cost associated with accessing the websites or any other entry mechanisms for the Promotion, is the entrant’s responsibility and is dependent on the Internet service provider used.
10.4 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or under any similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
10.5 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any other loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way in connection with the Promotion, including (without limitation) due to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if an event that is listed as part of the major prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of or taking of a Prize (including attendance or participation in a Prize where relevant).
