These terms and conditions include terms which:
(a) exclude liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or the winning of prizes;
(b) allow the Promoter to share your personal information with third parties for the purpose of conducting the application process; and
(c) enable the Promoter to use, copy, modify, publish and disclose your name, likeness, image or voice, and any content submitted by you as part of your participation (as applicable), for an unlimited time for the promotion of any products or services of the Promoter, without further reference or payment to you.
By participating in this promotion, you acknowledge and agree that you have understood and agree to the terms and conditions referred to above.

Entry is open to Australian and New Zealand residents (Eligible Entrants). Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion. Employees of the Promoter, related entities, members of the judging panel and the Promoter’s supplier conducting this promotion and their immediate families are not eligible to enter.
The promotion commences at 4:00pm AEST on Thursday 30th March 2023 and closes at 11:59pm AEST on Sunday 2nd April 2023 (Promotion Period). Entries must be received by the Promoter during the Promotion Period. Entries received after 11:59pm AEST on Sunday 2nd April 2023 will not be accepted.

The Promoter is committed to complying with all Federal, State and Territory Government in Australia, or all Central and Local Government in New Zealand(Government) gift and ethics policies. Employees and independent contractors of the Government (including education departments) must adhere to gift and ethics policies applicable to them when entering the promotion or accepting any prize.
The Promoter reserves the right to request verification of age, identity, residential address and any other information from Eligible Entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any Eligible Entrant whom the Promoter believes either has tampered with the entry process or has submitted an entry otherwise than in accordance with these terms and conditions of entry. The Promoter may in its sole discretion elect not to award a prize where it suspects that a person is not the original entrant.
All valid entries received during the Promotion Period will be reviewed by the judging panel. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on originality and creativity (Judging Criteria).
Judging will take place at 10:00am AEST on Monday, 3rd April 2023 at Level 27, 1 Denison Street, North Sydney, New South Wales, 2060. Entries will be judged by a panel of judges representing the Promoter.
The two entries deemed to be the best by the judging panel will each win: one (1) Xbox Series S Plushie. The total number of prizes is two (2). The Approximate Retail Value (ARV) of an Xbox Series S Plushie is $85.10 AUD, or $91.30 NZD. The total prize value is $170.20 AUD, or $182.60 NZD.
Prizes are not transferable or exchangeable and are not redeemable for cash. All taxes (excluding GST) and any ancillary costs which may be payable as a consequence of receiving the prize are the sole responsibility of the winner.
Winners of all prizes will be notified via Twitter direct message on or by 11:59pm AEST on Monday, 3rd April 2023. The names of the prize winners will be published on the @XboxANZ Twitter account.
Winners should allow 28 days for prize delivery. Prizes will be sent by the most suitable method of delivery for the prize (for example mail or email). The Promoter will notify the winner how they will receive their prize.
In the event that a prize is not claimed by 11:59pm AEST on Monday 1st May 2023, the judges will select an alternate winner on the basis of the Judging Criteria. The alternate winner will be notified Twitter direct message. In the event that the alternate winner does not claim their prize by 11:59pm AEST on Monday 5th June 2023, then the prize will be forfeited by the winner and neither cash nor any other prize will be awarded in lieu of that prize.
If any winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on their behalf.
If the Promoter is unable to supply the nominated prize, the Promoter reserves the right to supply another prize of greater or equal value.
The Promoter’s decision is final and no correspondence will be entered into.
No responsibility is accepted for entries not received by the Promoter. Entries will be deemed invalid if stolen, forged, mutilated or tampered with in any way. Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
Eligible Entrants warrant that their entry in the promotion does not infringe the intellectual property rights of any third party. The Eligible Entrant indemnifies and will keep the Promoter and its associated agencies indemnified against any loss, costs (including legal costs), expenses or liability the Promoter and its associated agencies may suffer arising out of a breach by the Eligible Entrant of this clause.
Eligible Entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use and modify their entry for the purposes of the Promoter’s business without the payment of any further fee or compensation. To the extent permitted by law, Eligible Entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
The stated prize value is the recommended retail value (including GST) in Australia and New Zealand as provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. The Promoter (including its respective officers, employees and agents) and its associated companies accept no responsibility for prizes damaged or lost in transit.
Any costs associated with entering the promotion, including accessing any website, are the responsibility of the Eligible Entrant.
These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable statutory guarantees as provided under the Competition and Consumer Act 2010 (Cth), the Fair Trading Act 1986 (NZ) and the Consumer Guarantees Act 1993 (NZ) or any other warranties (whether express or implied) under any legislation of Australia or New Zealand which cannot be excluded.
Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, or in connection with receiving, taking or using any prize.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize.
To the fullest extent permitted by law and without limiting any other terms and conditions of entry, the Promoter may, in its discretion, terminate, modify or suspend the promotion, subject to any directions given by any relevant authority. All Eligible Entrants participating in the promotion at the point of termination, modification or suspension of the promotion will be notified by the Promoter in writing. In the event of modification or suspension of the promotion, the Eligible Entrant may choose to terminate their participation in the promotion at no cost.
The Promoter assumes no responsibility, and the Eligible Entrant releases the Promoter from responsibility, for any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the Eligible Entrant’s participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an Eligible Entrant’s error, any technical problem (including communications or network failure, unauthorised access to, transferral of, or theft of, data), whether caused by the Eligible Entrant, or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion’s administration, security, fairness or integrity are compromised or affected, the Promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any Eligible Entrant involved in interfering or tampering with the conduct of this promotion in any way.
