TERMS AND CONDITIONS:
By entering the DON Guess and Win promotion (“the Promotion”), you agree to the following conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed as acceptance of these terms and conditions.
1.2 Entry into the competition is by way of
a) Solving the mystery word/s; and,
b) Purchasing any DON product at any Ritchies Supermarket, retaining a valid receipt and completing the entry form via the link available online.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia aged 18 years or over.
2.2 Employees and their immediate families of Ritchies Stores Pty Ltd ABN (61 005 041 814) (“the Promoter")and George Weston Foods Limited (ABN 45 008 429 632) and their associated agencies and companies, and related bodies corporate are not eligible to win. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. HOW TO ENTER
3.1 The Promotion commences on Wednesday 19th April 2023 at 7.30 am (AEST) and concludes Tuesday 6th June 2023 at 23:30 (AEST) (“Promotional Period"). To enter the purchaser must solve the “mystery word/s”, purchase any Don product at a participating Ritchies Supermarket, retain a valid receipt and then complete the entry form available during the Promotional Period. Incomplete or indecipherable entries will be deemed invalid. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3.2 Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per eligible transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) unrecognised receipts will be deemed invalid.
3.3 Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the retailer, products purchased, transaction total and that the Eligible Purchase was made during the Purchase Period but prior to entry. Winners drawn at random using a computerised draw.
3.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
4. PRIZE WINNERS

A total of forty nine (49) winners will each receive a $100 Ritchies Gift Card.

Draws will take place each Wednesday at 11am for 7 weeks, draw dates as follows:

Wk 3 - Wed 10th May 2023
Wk 4 - Wed 17th May 2023
Wk 5 - Wed 24th May 2023
Wk 6 - Wed 31st May 2023

A total of seven (7) winners will be drawn at random each week.
Each winner will receive one (1) Ritchies Gift Card to the value of $100AUD.
Winners will be published weekly online within 5 business days of the draw. All reasonable attempts will be made to contact each winner. Prize will be made available for collection at the winner’s home store as nominated on their entry.
4.2 PRIZE CONDITIONS
Prize cannot be transferred or exchanged and cannot be redeemed for cash.
Additional options and all ancillary costs are the responsibility of the major prize winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner.
In accepting the prize, the winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed, and photographed, and the winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.
Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
5 UNCLAIMED PRIZE DRAWS
5.1 Subject to any written direction any unclaimed prize draw from all non-winning entries will take place on 27/11/2023 at Ritchies Stores Pty Ltd Head office, 10/1095 Frankston Dandenong Rd, Carrum Downs, VIC 3201 at 10:00am (AEST).
5.2 The Promoter’s decision is final and the promoter will not enter into correspondence regarding the Promotion result.
5.3 It is a condition of accepting any of the prizes that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.
5.4 It is a condition of accepting any of the prizes that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
6 NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Ritchies Stores Pty Ltd ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, Ritchies Stores Pty Ltd may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under state regulation.
6.2 Ritchies Stores Pty Ltd and their associated agencies and companies, and related bodies corporate will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail including electronic mail. And further will not be liable for any misadventure, accident, injury, loss or claim that may occur:
During the draw;
In the participation in any prize;
As a consequence of late, lost or misdirected mail, telephone or internet malfunction;
Due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compare, staff member, journalist, other entrants or any other person;
Arising from or related to any problem or technical malfunction of any telephone network or lines, mobile or internet communications network related to or resulting from participation in this promotion.
6.3 Ritchies Stores Pty Ltd and their associated agencies and companies, and related bodies corporate assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
6.4 If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Ritchies Stores Pty Ltd which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, Ritchies Stores Pty Ltd reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under state regulation.
7.0 GENERAL
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at
www.ritchies.com.au/privacy1. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
