Terms and Conditions:
1. Participation in the MaxiPARTS Japanese Trucks Parts Promotion (“Promotion”) is subject to the following terms and conditions (“Terms and Conditions”). Information on how to enter the Promotion and win the prize forms part of these Terms and Conditions.
2. By submitting an entry into the Promotion, you will be deemed to have agreed to be bound by these Terms and Conditions. Only entries that comply with these Terms and Conditions will be considered valid and eligible to win. To the extent of any inconsistency between these Terms and Conditions and any other reference to the Promotion, these Terms and Conditions prevail.
3. The promoter of the Promotion is MaxiPARTS Operations Pty Ltd (ABN 76 110 786 215), (“MaxiPARTS”) having its principal office at 22 Efficient Drive, Truganina VIC 3029.
4. The Promotion commences at 12:00am AEDT on 13 February 2023 and ends for Qualifying Purchases (as defined below) at 11:59pm AEST on 15 May 2023 (“Purchase Period”). The right to submit an entry under the Promotion is effective from 12:00am AEDT on 13 February 2023 and closes at 11.59pm AEST on 15 May 2023 (“Promotion Period”). MaxiPARTS will only accept entries made during the Promotion Period. MaxiPARTS does not accept any responsibility for entries not received during the Purchase Period.
5. This Promotion is not valid in conjunction with any other offer.
6. This Promotion is not being conducted in the Australian Capital Territory.
Eligibility and Entry
7. To be eligible to enter the Promotion, you must during the Promotion Period: hold an account with MaxiPARTS (either a Trade, Cash Sales or online account) ("MaxiPARTS Account"). Participation in the Promotion is subject to the terms and conditions which apply to your MaxiPARTS Account (available on request), as amended from time to time. GST) on MaxiPARTS products which are branded with the label “Japanese Truck Parts” in any one transaction during the Purchase Period at any MaxiPARTS branch across Australia (including Distribution Centres) or online at
https://www.maxiparts.com.au correctly complete the entry form once a Qualifying Purchase has been made. Incomplete entry forms will not be accepted; and not be excluded from the Promotion as set out below.
8. You will be excluded from the Promotion if you are:
a major competitor of MaxiPARTS as determined by MaxiPARTS in its absolute discretion; or
a director, officer, member of management or an employee (or an immediate family member of such persons) of:
MaxiPARTS and its related bodies corporate;
any applicable government agencies (state, federal, and local government); and
the agencies, companies or participating premises associated with this competition.
9. MaxiPARTS may reasonably request further information from you, including to verify your identity and to confirm that you are an Eligible Entrant and have complied with these Terms and Conditions.
10. Each Qualifying Purchase entitles you to one (1) entry into the Promotion provided you are otherwise eligible. For example, a spend of AUD$250 = 1 entry into the Promotion, AUD$500 = 2 entries, AUD$750 = 3 entries, AUD$1,000 = 4 entries, and so on. There is no maximum spend or limit on entries.
11. In these Terms and Conditions, you will be an “Eligible Entrant” if you satisfy the conditions described above. If you are an Eligible Entrant and you submit an entry in accordance with these Terms and Conditions, that entry will be an Eligible Entry.
Prize
12. The prize is a “Trip for 2 to Japan” (“Prize”) to the value of $10,000, which includes:
2 x Economy Class Return tickets from either Brisbane, Melbourne or Sydney to Tokyo, Japan (Haneda Airport or Narita International Airport);
Airport Transfers to your accommodation in Japan for two adults;
Accommodation:
3 x nights’ accommodation for two people at Hotel Century Southern Tower, staying in a Twin Southern Tower Room with Daily Breakfast;
1 x night accommodation for two people at Hakone Airu, staying in a Twin Standard Japanese Room with Open Air Bath with Breakfast and Dinner; and
3 x night’s accommodation for two people at Hotel Granvia Kyoto, staying in a Twin Superior Room with Daily Breakfast, and
Day Green Japan Rail Pass for two adults.
13. Spending money, excess baggage costs, travel insurance, transport to and from the airport departure point, any additional transfers (other than those referred to in these Terms and Conditions) items of a personal nature, in-room charges, and all other ancillary costs are not included in the Prize, unless specified otherwise.
14. Passports and visas required for travel remain the responsibility of the winner of the Prize.
15. The Prize and booking of the Prize are subject to the standard booking terms and conditions of the relevant airline and accommodation provider.
16. The Prize must be taken during the period 1 June 2023 to 30 June 2024. If the winner of the Prize drawn in accordance with paragraph 20 (“Winner”) is unable to travel or accept the Prize for the prescribed dates, the Prize will be forfeited.
17. At the sole discretion of MaxiPARTS the Prize can be awarded to the winner as a travel voucher equivalent to the total prize value of $10,000.
18. The Prize is customisable and the travel components forming the Prize can be changed provided the value of the Prize does not exceed $10,000. Any amount exceeding $10,000 which is the result of customisations made by the Winner will be at the Winner’s expense. Any customisations must be made with MaxiPARTS’ appointed travel agency: Executive Travel Management located at Ground Floor, 1 Yarra Street, Geelong VIC 3220.
19. The Prize is not redeemable for cash or transferable.
Draw
20. The Winner of the Promotion will be drawn at random at 2:00PM (AEST) on 30 May 2023 at 22 Efficient Drive, Truganina VIC 3029 by MaxiPARTS, using the electronic system operated by Random Draw at
www.randomdraws.com.au, such that each Eligible Entry will have an equal chance of winning the Prize. There will only be one draw and there will not be a round in which Eligible Entrants are eliminated. Rather, the Eligible Entrant who submitted the Eligible Entry that is drawn by Random Draw on the draw date wins the Prize.
21. MaxiPARTS may draw additional reserve entries on the draw date (“Reserve Entrants”) and record them in the order drawn. In the event of an invalid entry, or an ineligible entrant, or if the entrant is ineligible to accept the Prize, the Prize will be awarded to the first Reserve Entrant drawn. If the Prize can’t be awarded to the first Reserve Entrant drawn, MaxiPARTS will continue this process until the Prize is awarded.
22. Eligible Entrants are not required to be in attendance at the draw.
23. The Winner will be notified in writing via email within 7 days of being drawn as the Winner and the results, including the Winner’s initials and postcode, will be published on MaxiPARTS’ website before 14 June 2023.
24. If the Winner is a corporate MaxiPARTS Account Customer, the Prize will be awarded to the company named as the account holder in the MaxiPARTS accounts system, not the individual who made the relevant purchase/s. The Winner in this situation may, in its sole discretion, nominate an individual to receive the Prize by providing MaxiPARTS with written notice of the nomination signed by an authorised representative of the Winner.
25. If the Prize has not been accepted or claimed by the prize claim date of 14 June 2023 (“Prize Claim Date”) or if, after making all reasonable attempts, MaxiPARTS can't contact the Winner (or the Winner does not contact MaxiPARTS) by the Prize Claim Date, the relevant entry/ies will be discarded and MaxiPARTS will re-award the Prize to a Reserve Entrant (“Reserve Winner”) on the same date. The Reserve Winner will be notified in writing via email within 7 days of the Prize Claim Date and the results, including the Reserve Winner’s initials and postcode, will be published on MaxiPARTS’ website by 30 June 2023.
26. If the Prize remains un-claimed, or if the Reserve Winner cannot be found, that information will be published on MaxiPARTS’ website on 30 June 2023.
27. The Winner agrees to have their photo taken together with their relevant MaxiPARTS Account company name (if applicable), last name, initial and postcode to be published on MaxiPARTS’ website and social media platforms within 30 days of the draw taking place.
General
28. All references to $ are to Australian Dollars.
29. MaxiPARTS’ decision is final and binding and no correspondence will be entered into. MaxiPARTS accepts no responsibility for late, lost or misdirected entries or technical difficulties.
30. The Winner accepts the Prize at their own risk. Subject to any applicable law which cannot be excluded, MaxiPARTS and its related bodies corporate are not liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the Promotion or the Prize.
31. MaxiPARTS and its related bodies corporate make no warranties and accept no liability in relation to the Prize.
32. If, for any reason, the Promotion is not capable of running as planned including by reason of tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of MaxiPARTS which corrupt or affect the administration security, fairness integrity or proper conduct of this Promotion, MaxiPARTS will disqualify any individual who tampers with the entry process, and (with the approval from the relevant authorities) may cancel, terminate, modify or suspend the competition.
33. MaxiPARTS reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Incomplete, indecipherable, or illegible entries will be deemed invalid.
34. All entries become the property of MaxiPARTS. The information from the entries is being collected by MaxiPARTS to enable it to contact the potential winner and/or may be entered into a database. By entering the Promotion you consent to MaxiPARTS using your personal details for an indefinite period (unless consent is later retracted) for future marketing purposes unless otherwise advised by the entrant upon entry.
MaxiPARTS will only use the Winner’s personal details for future marketing purposes relating to MaxiPARTS.
35. It is your responsibility to notify MaxiPARTS if your contact details change during the Promotional Period.
36. You consent to MaxiPARTS using your name, likeness, image and/or voice in the event you are the Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by MaxiPARTS.
37. The Winner acknowledges that elements of the Prize may be subject to additional terms and conditions imposed by third party suppliers connected with the Prize (which could include booking conditions, fare rules, including any amendment fees, baggage restrictions, conditions of carriage, codes of conduct and any standard restrictions or participation conditions. To the extent permitted by law, MaxiPARTS does not accept any responsibility, and is not liable for, any additional conditions imposed by third party service providers on the taking of the Prize, or for the breach of those conditions by any person and the consequences which may follow.
38. The Winner agrees to take full responsibility for any activities engaged in while travelling and engaging in the Prize. Travel insurance is not included in any Prize. Travel insurance is highly recommended to protect against additional costs which may be incurred in the event of unforeseen circumstances.
39. To the extent permitted by law, MaxiPARTS is not responsible for and cannot be held liable for any element of the Prize which is cancelled, delayed or rescheduled, or where the location is changed, or any other occurrence, which is out of the reasonable control of MaxiPARTS and any costs incurred as a result, including, without limitation, any accommodation costs will be the sole responsibility of the Winner.
40. MaxiPARTS does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified.
41. If requested by MaxiPARTS, the Winner must sign and return any release and indemnity provided by MaxiPARTS and / or its contractors as a condition of a Prize being awarded. Failure to return the signed releases and indemnities may result in the entitlement to the Prize being forfeited and the selection of another Winner.
Privacy
42. MaxiPARTS may collect your personal information such as name and contact details in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to associated entities of MaxiPARTS and other entities who may assist in the Promotion. Entry into the Promotion is conditional on providing this personal information.
