General

1. The Competition is a game of chance and is authorised under the Permits.

2. The material used to market and promote the Competition forms part of the Competition terms.  If there is an inconsistency between the material used to market and promote the Competition and the Competition terms, the Competition terms prevail. 3. The Competition period commences at 12:01am (AEST) on 03/04/2023 and ends at 11:59pm (AEST) on 30/06/2023 (Competition Period). The Promoter reserves the right to extend the Competition end date at any time (subject to regulatory approval).

Eligibility to enter

4. To be eligible to enter the Competition, you must:

(a) at the end of the Competition Period, be:

(ii) over 18 years of age ;

(iii) a resident of Australia;

(iii) a valid current Flybuys member (or new Flybuys member who joins during the Competition Period). To be a valid Flybuys member the Flybuys member account must include:
A. the member’s first and last name;
B. a postal address;
C. a contactable email address;
D.  a contact phone number current at time of draw and prize distribution; 

(b) not an be employee or Immediate Family Member of Flybuys or HCF Health Insurance or an agent of the Promoter who is connected with the competition;

(c) take out a new HCF health insurance policy which is accepted by HCF excluding Corporate, Ambulance Only and Overseas Visitors Health Covers and HCF Life Insurance products (new HCF policy) during the Competition Period;

(d) take out the new HCF policy directly through HCF online, over the phone or in a HCF branch and provide your Flybuys number at the time of joining;

(e) not have held a health insurance policy with HCF in the 6 months prior to taking out the new HCF policy; and

(f) make your first payment of the premium for the new HCF policy during the Competition Period.

Entering

5. By meeting the criteria in paragraph 4 and not opting out of the Competition under paragraph 8 by the end of the Competition Period, entrants accept the Competition terms.

6. If Flybuys members meet the criteria in paragraph 4, they will be automatically entered into the Competition. 

7. You will only be entered into the Competition once per new HCF policy.

8. If you meet the eligibility criteria in paragraph 4 but do not wish to participate in the Competition you must advise the Promoter by calling the Flybuys service centre (13 11 16) before the end of the Competition Period.

9. The Promoter may disqualify any entrant who:
(a) has been entered into the Competition without being eligible;
(b) tampers with the entry process;
(c) does not comply with the Competition terms; or
(d) engages in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the Competition or the Promoter.

10. Failure by the Promoter to exercise its rights under paragraph 9 does not constitute a waiver of the Promoter’s rights under paragraph 9. If the entrant’s contact details change, the entrant must notify the Promoter.

Drawing winners

11. The Promoter will draw the winners from the pool of valid entrants at the Draw Time at the Draw Address.

12. The first valid entry drawn will win the First Prize, the next 35 valid entries drawn will each win a Second Prize and the next 75 valid entries drawn will each win a Third Prize, subject to the Promoter’s rights under paragraph 9. 

13. The Promoter will notify the winners by mail (or via email) on or before 17/07/2023 and the winners’ names and postcode will be posted on the Website on or before 21/07/2023.

Awarding Prizes

14. Prize will be awarded via email to the Flybuys member identified on the new HCF policy as the main policy holder. 

15. The Promoter may request that a winner provide proof of identity, proof of age and proof of residency to the Promoter’s reasonable satisfaction before awarding the prize. If a winner does not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction within 90 days after being selected as a winner, the Promoter may redraw the prize in accordance with paragraph 18. 

16. In consideration of the Promoter awarding a Prize to a winner, the winner:

(a) consents to the Promoter using his or her name, likeness, image, voice and entry in any marketing and promotion of the Competition, the Promoter or the Promoter’s business;

(b) agrees to use the prize in accordance with the supplier’s specified requirements; 

(c) agrees that the prize is not transferable or exchangeable and cannot be taken as cash;

and

(d) agrees to comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.

17. If a prize is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any approvals from regulatory authorities.  If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the prize with another item or items determined by the Promoter to be of equal or higher value.

Further draw

18. If for any reason, there are Prizes that have not been awarded by 10:00am (AEDT) on 8/10/2023,  the Promoter may conduct a further draw in respect of any unclaimed prizes from the pool of valid entries at 10:00am (AEDT) on 10/10/2023 at Focal Promotions, 2/7 Stayner Street Beaumaris VIC 3193.

19. The first valid entry the Promoter draws is the winner, subject to the Promoter’s rights under paragraph 9. If two or more prizes are included in the draw the first valid entry drawn will win the most valuable prize, the second valid entry drawn will win the second most valuable prize, and so on, until all available prizes have been allocated.

20. The Promoter will notify the winner of the further draw by mail (or via email) within 7 days after the further draw date. The Promoter will post the winner’s name and postcode on the Website within 7 days after the further draw date.

Force majeure

21. If there is a Force Majeure Event which prevents or materially and adversely affects the Promoter’s ability to market, promote and run the Competition in accordance with the Competition terms, the Promoter may cancel, terminate, modify, suspend or postpone the Competition subject to State Licensing Authorities approval.

Liability

22. Nothing in the Competition terms is intended to limit entrants’ or winners’ rights under the Australian Consumer Law (Non-Excludable Guarantees).

23. Subject to the Non-Excludable Guarantees, the Promoter is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the Competition, including:

(a) any late, lost, altered, damaged or misdirected entries or prize acceptance, including delays due to technical disruptions or network congestion;

(b) any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Competition;

(c) any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; 

(d) any theft, destruction, unauthorised access to or alteration of entries; and

(e) any use of the prize or any tax liability incurred by the winner as a result of accepting the prize.

24. The Competition is in no way sponsored, endorsed or administered by, or associated with, any social media provider and no social media provider is liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the Competition.

Personal information

25. The Promoter collects personal information about entrants in order to run the Competition and comply with the Permits. The Promoter uses and manages entrants personal information in accordance with its privacy policy at www.flybuys.com.au/about/#/privacy-policy. By entering the Competition, each entrant consents to the Promoter disclosing the Winners’ First Name, Last Name and email address to Focal Promotions (ABN: 76 007 374 325) and giftcards.com.au owned and operated by Coles Group (ABN: 11 004 089 936) for draw eligibility requirements and for the purpose of facilitating the prize. Prize Conditions

    The ‘Year's Worth of Coles Groceries’ first prize value is based on the weekly average spend for an Australian household which was reported by the Finder Consumer Sentiment Tracker, July 2022 – February 2023 to be $185 per week.
    $185 x 52 weeks = $9,620 a year spent on groceries.

    Coles Gift Cards must be treated like cash and once dispatched, the Promoter is not liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.

Flybuys points 
To receive the Flybuys Increased Points Offer your cover must be active (i.e. not terminated or suspended) for at least 10 calendar months (10 Active Months Period) and your cover premium must be paid up to date as at the end of the 10 Active Months Period. Points awarded per policy to the Flybuys account nominated by the policyholder. Flybuys standard points will be awarded in one instalment in the month following the 10 Active Months Period. Number of points awarded depends on the annual premium value as at the last day of the calendar month in which your cover started or your first premium payment is made (whichever is later) - See Points Table for details.  
 
Suspension, cancellation or changes 

If you suspend your cover at any time within the first 12 months of the commencement of your cover, your points earning eligibility will also be suspended. You will receive the points when your cover is recommenced and you have met these terms and conditions. 

If you cancel your cover or you transfer to an excluded policy before completing the 10 Active Months Period, you will not receive any points. 

If you change your level of cover, which results in a change to the total annual premium value, your standard points will be awarded in accordance with the total annual premium value as at the last day of the calendar month in which your cover started or your first premium payment is made (whichever is later). 

General 
• The Increased Points Offer is only available if you join through the HCF website or via an HCF call centre or branch.
