Conditions of Entry
Entry into this promotion is deemed acceptance of these terms and conditions of entry by each entrant.
The Promoter is M-Hospitality, ABN 16 163 975 460 of 8 Artists Lane, Windsor, Victoria 3181 (“Promoter”)
Entry is open to residents of Australia aged 18 years or older, who enter the promotion in the required manner as stated in these terms and conditions (“Eligible Entrants”)
Duration of Promotion Period:
Promotion commences at 12pm, Thursday, 6 April 2023 (AEST) and closes at 11.45pm, Saturday, 30 September 2023 (AEST)a (“Promotion Period”).
How to Enter:
Eligible Entrants may only enter once. Additional entries may be gained via social media and referrals.
In order to enter, a participant must subscribe to receive email communications from Mr. Miyagi by providing their full name, email address, date of birth and mobile phone number, and they must remain subscribed at the time of selection to be eligible.
Entries will be deemed to be accepted at the time of the Prize Winner selection.
Entries must be received by the Promoters during the Promotion Period. The Promoter does not accept responsibility for late, lost or misdirected entries.
Any costs associated with accessing the promotion are the responsibility of each entrant.
The Promoter takes no responsibility for any variation in the value of the prize.
If the Prize Winner does not accept any element of the Prize, the Promoter is not obligated to provide the Prize Winner with a substitute Prize.
Selection of the Prize Winner:
There will be one (1) Prize Winner.
The Prize Winner will be selected on Monday, 2 October 2023 at M-Hospitality; 8 Artists Lane, Windsor VICTORIA 3181.
The Prize Winner will be selected by random draw under the supervision of M-Hospitality.
The Prize Winner will be notified by email or telephone on Monday, 2 October 2023 following the draw.
The Promoter may promote the Prize and Prize Winner across social media channels owned by M-Hospitality.
The Prize Winner will have until 5.00pm Friday, 6 October 2023 to claim the Prize. If the prize is not claimed by this time an Unclaimed Prize Draw will take place on the same day at M-Hospitality; 8 Artists Lane, Windsor VICTORIA 3181.
Prize Details:
One (1) winner will receive a Golden Package prize for two (2) adults aged 18 years or older. The Golden Package includes;
Double Pass (2 tickets) to any concert at Rod Laver Arena between Monday, 2 October 2023 – Wednesday, 2 October 2024. This excludes tickets to the Australian Open and the FIFA 2023 Women’s World Cup.
Dinner for two at Mr. Miyagi prior to the selected show, up to the value of $350AUD
Car transfer from Mr. Miyagi to Rod Laver Arena for the selected show.
One night stay at a luxury hotel in Melbourne the night of the chosen concert.
Prize must be taken in its entirety and completed by Wednesday, 2 October 2024. Prize excludes Public Holiday periods. If the Prize cannot be taken beforehand, it will be forfeited without any compensation to the winner.
Prize is subject to availability at the time of booking.
Transfers are only available from Mr. Miyagi to Rod Laver Arena, all other transfers, travel and additional costs not included in the prize inclusions are at the expense of the winner.
The winner will be responsible for any costs associated with reaching Melbourne.
Winner is to provide a minimum of 30 days’ notice of intended event.
Travel insurance is not included in the prize and remains the responsibility of the winner.
The Prize Winner must take the Prize as offered. The Prize is not transferable, redeemable, refundable, and cannot be sold or exchanged for cash. The Prize cannot be used in conjunction with any other offer.
The Prize and booking of the Prize are subject to the standard booking and terms and conditions of the Promoter and Rod Laver Arena and Melbourne & Olympic Parks.
General:
The personal information of entrants will be collected to enable the Promoter to administer and promote this promotion and to contact the Prize Winner (or, if applicable, the winner of an Unclaimed Prize Draw). Entrants agree that the Promoter may handle their personal information in accordance with the Promoter's privacy policy. Entrants agree that the Promoter may use their personal information and entries for marketing purposes. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the Prize.
The personal information of the Prize Winner will be provided to others assisting, including prize suppliers and deliverers.
All entrants who submit any entry to the Promoter: (a) grant the Promoter and its licensees and assignees a non-exclusive license to exercise all rights in perpetuity throughout the world in the entry material and all other material provided by the entrant to the Promoter pursuant to this promotion at any time; and (b) represent and warrant that the exercise of the rights granted to the Promoter in these terms and conditions will not infringe the rights of any third parties; and (c) indemnify the Promoter against any loss or damage resulting from any breach of the foregoing representation and warranty.
To the extent permitted by law, the Promoter is not responsible or liable for:
inaccurate/incorrect transcription of entry information;
purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions.
The Promoter will not be liable for personal injury suffered during participation in the promotion or use of the Prize, except to the extent directly caused by the Promoter's negligence. If requested by The Promoter, the Prize Winner(s), and his or her guests, must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a Prize being awarded. Failure to return the signed releases and indemnities may result in the entitlement to the Prize being forfeited and the selection of another Prize Winner.
The above conditions do not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.
