TERMS AND CONDITIONS:
The Dymocks Book Quotes competition ("Competition") is offered by Dymocks Franchise (NSW) Systems Pty Ltd ("Dymocks") (the "Organiser") subject to the terms and conditions set out below (the "Terms and Conditions").
By participating in this Competition, each entrant warrants that they meet the eligibility requirements and accepts these Terms and Conditions.
Who Can Enter?
Entry is only available to people who are currently a resident in Australia and aged 18 years or older. The Organiser’s employees, officers, partners and contractors in connection with this Competition (and their immediate family members) are ineligible to enter the Competition.
How To Enter?
The Competition starts at 9.00am AEST on Wednesday 9 August 2023 and ends at 11.59pm AEST on Thursday 31 August 2023 ("Competition Period").
To participate in this Competition, entrants must:
1. Create and post a TikTok video between 10 and 60 seconds sharing their favourite book quote ("Video");
2. Post the Video on their TikTok account within the Competition Period and include the hashtags #booktok, #bookquotes and tag @dymocksbooks within the caption of the post;
3. Be willing to provide their contact details during the Competition Period through the sign up form or page shared with entrants (or otherwise published by Dymocks);
4. Ensure that the privacy settings of the video are set to "public" and the video is publicly accessible; and
5. Ensure the video produced complies with TikTok's Community Guidelines.
Each TikTok post fulfilling all of the above criteria shall be referred to as an "Entry". Entrants can submit multiple Entries for the duration of the Competition Period. However, each entrant can only win 1 prize.
By submitting an Entry, you agree that your Entry or Entries may be used in accordance with Item 8 of the Further Terms and Conditions set out below, including on digital screens in Dymock's stores throughout Australia.
Judging Criteria
Dymocks, in its sole discretion, will select 1 x winner and 5 x runner up winners from the Entries submitted during the Competition (each a "Winner" and collectively the "Winners").
The criteria for selecting the Winners includes (but is not limited to):
1. Quality, creativity, relatability and distinctiveness of the Entry; and
2. Level of engagement with the video (e.g. number of likes, video views, comments, etc.).
These matters are the "Judging Criteria".
This is a game of skill and chance plays no part in determining the Winner. Dymocks' decision in relation to the choice of Winner is final.
Prizes
Dymocks will select, in its sole discretion and based on the Judging Criteria:
1. 1 x Winner to receive AUD$1,000 cash;
2. 5 x runner up Winners to each receive a $50 Dymocks book voucher.
Each Winner will receive these prizes, subject to the further terms and conditions below and execution of a prize release deed. All prizes will be contributed by Dymocks.
Notification and claiming Prizes
1. The Winners will be selected by Dymocks following the conclusion of the Competition and announced on or before 11 September 2023 via a post on the Dymocks Australia TikTok account @Dymocksbooks, and contacted via email with information and instructions for redeeming their prize. The Winners' TikTok usernames may also be published on the announcement.
2. Winners will have 3 days (or such other time notified by Dymocks) from the time and date of the notification being sent to: (i) respond to the notification from Dymocks that they are a Winner; and (ii) provide proof of eligibility (which may include presenting identification, such as drivers licence or passport, for verification purposes via a video call). In the event any prize is unclaimed, such prizes will be dealt with at Dymocks’ sole discretion.
3. The Organiser reserves the right, in their sole and absolute discretion and without prior notice, to substitute the prizes with other prizes of equivalent value if it deems fit.
4. The Organiser reserves the right to refuse the claiming of a prize by a Winner if the relevant Winner does not comply with these Terms and Conditions.
5. Prizes are not transferable or redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. Prizes may be subject to additional terms and conditions, and the Winners agree to comply with all terms and conditions applicable to the prizes.
Further Terms and Conditions
General
1. Entries submitted before or after the Competition Period and/or not fulfilling the conditions in these Terms and Conditions, will not be eligible for the Competition. The time and date of submission for each Entry is calculated using the time/date stamp applied to the Entry on the TikTok app. Any complaints in relation to missing or delayed submissions will not be considered by the Organiser.
2. Entrants are responsible for any and all expenses incurred in entering or participating in the Competition. Entrants will not be reimbursed for any expenses incurred in participating in this Competition.
3. Each entrant acknowledges and agrees that their Entry will be publicly available, available for commenting on by the public, and that comments or ratings that the entrant disagrees with or is unhappy about may be published or otherwise become associated with the Entry.
4. Each entrant represents and warrants that: (i) each of their Entries is original and has not been previously published, (ii) they possess the exclusive rights to use and communicate their Entries, (iii) their Entries do not infringe the intellectual property, privacy, publicity or other rights or interest of any third party or result in any other liability; and (iv) their Entries do not violate TikTok's Community Guidelines.
5. If this Competition is interfered with in any way, or is not able to be conducted as the Organiser reasonably anticipated, the Organiser reserves the right, at their sole discretion, to disqualify any entrant or Entries, or to modify, suspend, terminate or cancel the Competition, as appropriate. Dymocks also reserves the right to moderate any Entries, and to disqualify any Entries in breach of these Terms and Conditions, including where the entranthas acted in a way that may bring the Organiser or the Entrant into disrepute.
6. To the maximum extent permitted by law, the Organiser (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of (i) the Competition, (ii) any technical difficulties or equipment malfunction (whether or not under the Organiser’s control); (iii) any theft, unauthorised access or third party interference; (iv) any Entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Dymocks) due to any reason beyond the reasonable control of the Organiser; (v) any variation in prize value to that stated in these Terms and Conditions; (vi) any tax liability incurred by a winner or entrant; or (vii) use of a prize.
7. To the maximum extent permitted by law, each entrant agrees to indemnify and hold the Organiser harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from the alleged or actual infringement of any third party copyright, patent, trademark or other intellectual property rights, or other rights, any breach of these Terms and Conditions and/or arising out of or in connection with the Competition.
8. Each entrant consents and agrees that the Organiser and their affiliates can publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute or use the entrants' particulars (including any publicly available TikTok or Facebook or Instagram profile photo and details) and/or the Videos and Entries (or any part thereof): (i) in connection with, or promotion of, this Competition, or the Organiser (including on digital screens in Dymocks book stores); (ii) in any manner, format or media, in any part of the world, including without limitation on online platforms such as TikTok, Facebook, YouTube, Twitter and Instagram; (iii) at the Organiser’s sole direction, including for any promotional or marketing purposes of the Organiser; and (v) royalty-free and without any obligation of attribution or consent. Each entrant irrevocably grants to the Organiser all consents and waivers necessary in connection with the above, without further compensation to the entrant.
9. The Organiser reserve the right to change these Terms and Conditions without notice and at any stage during the Competition. In the event of any dispute arising from the Competition or relating to the interpretation of these Terms and Conditions, the Organiser’s decision shall be final and binding on all parties.
Privacy
10. The Organiser collect entrants' personal information in order to conduct the Competition and to exercise the Organiser’s rights under these Terms and Conditions. Each entrant consents to the Organiser using, processing and/or disclosing (including to third parties overseas) their personal information for this purpose, in accordance with these Terms and Conditions. If the information requested is not provided, the entrant may not be able to participate in the Competition or receive a prize. View Dymocks' privacy policy.
11. By participating in the Competition, each entrant agrees to receive electronic communications from the Organiser (such as via email or direct message). Each entrant agrees that the Organiser may, for a reasonable period of time, unless otherwise advised, use the entrant's information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrants.
Promotional Activities
12. Each entrant agrees (i) to take part in any and all marketing, promotional, publicity requests from the Organiser with respect to the Competition, (ii) that the Organiser may use the entrant's name, voice, photograph, likeness or other personal identifiable information in any media for the promotion and publicity of this Competition, (iii) to grant Dymocks all consents and waivers necessary for the Organisers to run and promote the Competition, including in respect of any promotional photographs and/or audio/ video recordings taken of the entrant.
13. Entrants shall not, without the prior written approval of the Organiser, speak to the press or any other media, or give any interviews or comments relating to the Competition
