TERMS AND CONDITIONS:

“The Promoter” is The Coffee Club Franchising Company Pty Ltd ACN 128 563 333 trading as The Coffee Club, Level 13, 199 Grey Street, South Bank QLD 4101.
2. By entering this competition, you agree and are automatically deemed to have read, understood, and accepted these terms and conditions (terms).
3. If there is any inconsistency between these terms and anything else that refers to this competition, these terms will prevail.
Who Can Enter
4. Entry is open to all Australian residents over the age of 18 years who are signed up The Coffee Club Rewards App, except employees and immediate families of the Promoter and their associated companies and agencies. Immediate family includes but is not limited to: spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, sibling, uncle, aunt, niece, nephew.
5. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership to claim a prize.
6. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
When to Enter
7. The promotion opens at 7:00am AEST on 16 August 2023 and closes at 11:59PM AEDST on 12 September 2023 (“Promotional Period”).
8. Entries must be received by the Promoter prior to the competition close date and time. The time of entry will in each case be the time the online entry is received by the Promoter’s database, not at the time of transmission by the entrant.
9. The Promoter accepts no responsibility for any late, lost, or misdirected entries due to technical disruptions, network congestion or for any other reason.
How to Enter
10. This is a game of chance, where entrants are required to complete and submit an entry form online. Access to the entry form will be provided at Participating Stores (defined below) on advertising material containing a QR code.
11. To enter, entrants must spend a minimum of AUD $25.00 in a single transaction for an over the counter purchase at a Participating Store (defined below), scan the QR Code, enter their personal details and upload a photo of their receipt from their qualifying purchase during the Promotional Period (“Qualifying Purchase”). Orders placed by order at table, click and collect and for delivery are excluded.
12. A person may submit one (1) entry for each Qualifying Purchase.
13. A participating store is any The Coffee Club restaurant or café in Australia that displays advertising material for this promotion (“Participating Store”).

14. The cost of accessing the promotional website will be dependent on the entrant’s individual internet service provider.
15. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these terms.
16. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
17. The Promoter reserves the right to:
a. disqualify any entrant who:
i. tampers with the entry process (including but not limited to entrants and households who use multiple email addresses or third-party software or applications);
ii. submits an entry that is not in accordance with these terms; or
iii. in the opinion of Promoter, engaged in conduct, which is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the promotion and/or Promoter;
b. moderate, monitor, delete, or reject any or all entries submitted at its sole discretion, including removing content it considers to be incomplete, indecipherable, inappropriate, offensive, unlawful, or otherwise not in the spirit of the promotion.
Draw and Notification
18. At the end of the competition, all valid entries for that day will go into a draw. The draw will take place at Level 13, 199 Grey Street, South Brisbane QLD 4101 at 11:00AM AEST on 14 September 2023, in the presence of an independent scrutineer, with two (2) winners drawn. The Promoter may draw additional reserve entries and record them in case of an invalid entry, or if an ineligible entrant is drawn.
19. The winners will be notified by the Promoter by telephone and email within two (2) business days of the draw. The winners will also be published at www.coffeeclub.com.au from 20 September 2023.
20. If the winners do not register their acceptance of the prize with the Promoter by email by 11:59PM AEST on 5 October 2023, the winners will be deemed to have not accepted, and forfeited, their entitlement to the prize.
21. The prize will be awarded to the owner of the phone number that made the valid entry.
22. Any prize draw decisions are final and binding and no correspondence will be entered into.
23. A draw for any unclaimed prizes will take place at 11:00AM AEST on 9 October 2023 at the same place and in the same method as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their names will be published at ww.coffeeclub.com.au from 12 October 2023.

The Prize
Bali Vacation Prize
24. The first (1st) valid entry drawn will win a Bali vacation for one (1) person and three (3) companions of any age, valued at up to $12,000.00 (“Bali Vacation Prize”). The Bali Vacation Prize includes:
• One (1) flight voucher issued by Allure Travel by CTM for Four (4) return economy flights from your nearest Australian Capital City to Bali Indonesia Gusti Ngurah Rai International Airport, valued at up to $5,000.00;
• Four (4) return transfers from Bali Indonesia Gusti Ngurah Rai International Airport to Anantara Vacation Club Legian Bali (Bali Resort);
• Five (5) nights’ accommodation in one (1) Two Bedroom Suite, with daily breakfast for four (4) people at the Bali Resort, valued at up to $7,000.00;
25. Additional spending money, passports, visas, travel insurance, vaccinations, meals, taxes, baggage charges, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included.
26. For removal of doubt, the Promoter will disclose the contact details of the winner to the Bali Resort and Allure Travel by CTM. The winner will be responsible for, and required to:
(a) liaise directly with the Bali Resort to arrange accommodation booking, return transfers and details; and
(b) book their own return flights using the Allure Travel by CTM voucher.
27. To accept the Bali Vacation Prize, the winners (and their companion/s) must:
a. sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a media consent form, legal release and indemnity form. In the event a winner or winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf; and
b. take out travel insurance to the Promoter’s satisfaction at their own expense (which may include comprehensive travel insurance covering property loss and damage and full medical cover). The winner and their companion must provide evidence of valid travel insurance to the Promoter in order to receive the Bali Vacation Prize.
28. The Promoter will not be held accountable or responsible for any flights that are missed, delayed or cancelled for any reason. Flights cannot be rescheduled. Travel is valid for use during the low, medium and high seasons, excluding the periods from 23 December 2023 – 8 January 2024 (inclusive) and 9 February 2024 – 17 February 2024 (inclusive). Validity cannot be extended. Bookings are for four (4) guests at the Bali Resort, subject to availability and cannot be changed by the winner. The accommodation included in the Bali Vacation Prize may only be redeemed once and is not to be used in conjunction with any other offer or discount. Cancellations or amendments to bookings must be made within 24 hours of arrival and may incur a forfeit of the Bali Vacation Prize. Additional charges or fees over and above the express inclusions of the Bali Vacation Prize are the cost of the winner. When redeeming your prize, should your travel plans be effected by Covid, the flexibility terms of the accommodation will apply and covid protocols will be followed. Any charges associated with, or related to, bookings, upgrades, incidentals, and extra person surcharges are the responsibility of the winner.

30. The prize (or any unused portion of the prize) cannot be transferred, resold, exchanged, or redeemed for cash.
31. Prize can only be redeemed on the date of the reservation and no part of the prize will be renewed, replaced or exchanged if the prize winner or their companions are unable to attend on the date of reservation for any reason.
32. All components of the prize are subject to COVID-19 rules and guidelines.
33. The Promoter and the Bali Resort management hereby expressly reserve the right, within their sole discretion, to reject any winner and their companion/s, and/or terminate any element of the Bali Vacation Prize, for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Maldives Prize
34. The second (2nd) valid entry drawn will win a Maldives vacation for two (2) adults, being the winner and one (1) companion aged 18 years and over, valued at up to AUD $10,000 (“Maldives Prize”). The Maldives Prize includes:
• One (1) flight voucher issued by Allure Travel by CTM for Two (2) return economy flights from your nearest Australian capital city to Velana International Airport, Male in the Maldives, valued at up to $5,000.00;
• Two (2) return transfers from Velana International Airport to Anantara Veli Maldives Resort (Maldives Resort) by speedboat; and
• Five (5) nights’ accommodation in one Superior Over Water Villa at the Maldives Resort, with daily breakfast included, valued at up to $5,000.00.
35. Additional spending money, passports, visas, travel insurance, vaccinations, meals, taxes, baggage charges, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included.

37. To accept the Maldives Prize, the winner (and their companion/s) must:

Flights requirements and restrictions are subject to the airlines booking conditions. Travel is between 1 September 2023 to 31 July 2024 excluding the periods from 20 December 2023 to 10 January 2024 (inclusive), and 24 March 2024 to 31 March 2024 (inclusive). Validity cannot be extended. Bookings are for two (2) guests at one (1) Superior Over Water Villa at the Maldives Resort, subject to availability and cannot be changed by the winner. The accommodation included in the Maldives Prize may only be redeemed once and is not to be used in conjunction with any other offer or discount. 45. All entrants agree that if they win the prize, they will:
a. not sell or otherwise provide their story and/or photographs to any media or other organization, without the prior written consent of the Promoter;

b. comply with all the conditions of use of the prize and prize supplier’s requirements, if any;
c. receive and take the prize on an “as is” basis, without warranty of any kind, express or implied (including but not limited to without any implied warranty of merchantability or fitness for a particular purpose); and
d. be liable for all costs associated with the use of the prize, including but not limited to flights, transport, parking, insurance, transfers, spending money and accommodation, if applicable.
46. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
47. Where the prize includes a ticket, ticket allocation (date and seating) will be at the Promoter’s sole discretion.
48. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State or Territory legislation.
Entrant’s Warranties
49. By partaking in the promotion, the entrant:
Liability
a. consents to the collection, use and or disclosure of information provided by it for internal research, and current and future promotional, advertising and marketing activities of the Promoter, its associates and its prize sponsors, whether in Australia or overseas;
b. agrees for the Promoter and its associates to contact them and send and/or provide information via telephone, mail, in person, email, SMS and any other form of communication medium;
e. consents to and authorises the use of their name, likeness, voice and image in any publicity material as determined by the Promoter at its sole discretion and/or as may be required by the relevant lottery and/or gaming legislation, without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter;
f. consent to their entry becoming the property of the Promoter pursuant to the Copyright Act 1968 (Cth) or otherwise; and
g. acknowledges and agrees that the Promoter is entitled to do any of the abovementioned acts without compensation or fee, and that such consent is enduring.
50. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend this competition, including but not limited to circumstances where:
a. an outside act, agent or event prevents or significantly hinders the Promoter’s ability to proceed with the competition, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, pandemic, war, act of terrorism;

b. the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, or technical failures which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion.
51. The prize winners acknowledge and agree that the Promoter is not responsible or liable for:
a. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
b. unauthorised human intervention in any part of the competition;
c. electronic or human error which may occur in the administration of the competition;
d. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
e. any theft, unauthorised access or third party interference;
f. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
g. any variation in prize value to that stated in these terms;
h. any delay, cancellation, postponement or attendance of a prize, if applicable; and
i. any tax liability incurred by a winner or entrant.
52. These conditions do not affect, and are not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
Statutory Warranties
53. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth) or any other relevant legislation which cannot be excluded, restricted, or modified.
54. Notwithstanding clause 54, to the fullest extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered, including but not limited to direct, indirect or consequential loss, or for any personal injury suffered or sustained in connection with the prize, promotion or competition except for any liability which cannot be excluded by law.
55. Each entrant shall indemnify the Promoter (and their respective directors, officers, employees and agents (each an “indemnified person”) for any loss, liability, cost, damage or expense suffered or incurred by any indemnified person as a result of:
c. the entrant breaching any of these terms;
d. a warranty given by the entrant proving to be untrue; or
e. any personal injury arising from or related to any wrongful or negligent act or omission by the entrant in connection with this competition.

Privacy
56. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.coffeeclub.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant, without notice and without any fee being paid unless otherwise advised by the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. By entering this competition, entrants confirm that they allow their PI to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out on its website www.coffeeclub.com.au. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
General
57. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered.
58. To the extent it is legally possible, this agreement is governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of Queensland, Australia.
