Information on how to enter this competition (Promotion) forms part of the terms and conditions of entry. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

Who can enter – Entry is open to all permanent residents of Australia over 18 years of age. Employees and their immediate families of The Art Gallery of New South Wales and their agencies and companies associated with the Promotion are ineligible to enter the competition.
How to enter – Participants may enter by completing the online entry form set out on the Promoter’s website
www.artgallery.nsw.gov.au. Eligible Participants will be required to provide their name, email address, phone number, suburb, state, country, postcode to complete their entry. Incorrect, incomplete or incomprehensible entries will be ineligible. Limit one entry per person. Entry is free. Each eligible entry will have an equal chance of winning. Promoter reserves the right to remove duplicate entries. All entries become the property of the Promoter. By entering the Promotion, Participants agree to the Promoter using and disclosing their personal information in accordance with these terms and conditions and with the Promoter’s Privacy Policy

The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who enters and no correspondence will be entered into.

If the Prize remains unclaimed at this time, a redraw will take place at 11.00 am (AEDT) 19 February 2024 and the person drawn from the remaining valid entries will be the Winner
Prizes cannot be transferred. Non-cash prizes cannot be redeemed for cash.
The Promoter reserves the right to request that the winner/s provide proof of age, identity and proof of residency. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter also reserves the right to require confirmation of acceptance of these terms and conditions by a winner, before awarding the prize.
The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not of legal age to use all prize elements. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
If for any reason this Promotion is not capable of running as planned, including due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
The winner must accept the prize within ten (10) business days of the prize draw. Where a prize is required to be sent to the winner, it will be sent via registered post and dispatched within two (2) weeks of the prize draw.
It is a condition of entry that the winner agrees to the publication of their name (using winner’s first name, first initial of last name) and state on the website (
www.artgallery.nsw.gov.au) which will occur within two (2) days of accepting the prize.

Membership prizes are offered by the Art Gallery Society (a Promotional Partner) and are subject to the terms of membership

At the time of winning membership prizes, the winners' details will be provided to the Art Gallery Society of New South Wales to process the 12-month Family Inspire membership.
Dining vouchers are promotional vouchers and are subject to the terms of the Fresh Collective (a Promotional Partner). Art Gallery Cafe dining voucher is valid for use at the Gallery Cafe located in the South Building of the Art Gallery of New South Wales only and expire on 31 January 2025. The voucher must be used in one transaction and any unused amount will be forfeit. The voucher should be treated like cash and will not be replaced if lost or stolen.
Gallery Shop prize packs are provided the Promoter. Prize pack selections are not transferable or exchangeable and cannot be redeemed for cash. If a prize component is unavailable for any reason, the Promoter may substitute another item of equal or higher value for that prize component as determined by the Gallery Shop. The Promoter accepts no responsibility for any variation in prize value.
In the event that for any reason whatsoever a winner does not redeem an element of the prize within the validity period stipulated by the Promoter or relevant Promotional Partner then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
The Promoter and the Promotional Partners exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, Prize claims or Prizes; and/or (iv) acceptance and/or use of any Prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims. The winners take and use the Prizes at their own risk.
Without limiting the previous paragraph, the Promoter and its associated agencies, companies and Promotional Partners will not be liable for any damage in transit to Prize(s), or for any consequences of the Winner or their companion not complying with any applicable laws and regulations regarding the use of the Prize.
The Promoter reserves the right to cancel or reschedule the competition or vary the terms, where, for reasons beyond the reasonable control of the Promoter, the Promoter is unable to provide the prizes as offered.
The Promoter collects personal information (‘PI’) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Promotional Partners and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle personal data collected from Participants (‘PI’) as set out in its applicable privacy statement, which can be viewed at
www.artgallery.nsw.gov.au/privacy. In addition to any use that may be outlined in the Promoter’s privacy statement, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or otherwise contacting the Participant. Aggregated, non-personal data may also be used for the purpose of market research or in facilitating reviews, developments and improvements to relevant services. Participants can unsubscribe at any time via the unsubscribe link in any Artmail email communication. Participants should direct any requests to opt out, access, update or correct PI to the Promoter.
The Promoter’s Website may contain links to other websites (Linked Sites), including Promotional Partner websites. The Promoter is not responsible for the content of any Linked Sites, whether or not the Promoter is affiliated with the Linked Sites. The Promoter does not in any way endorse any Linked Sites and is not responsible for the quality or delivery of any products or services offered, accessed or advertised by such Linked Sites. To the extent that these Linked Sites collect personal information or postings from Participants, the Promoter shall bear no responsibility or liability for the manner in which such information or postings are used or exploited. The Linked Sites are for Participants’ convenience only and Participants agree to access them at their own risk.
The promotion and these Terms and Conditions will be governed by the laws of New South Wales. The parties accept the non-exclusive jurisdiction of courts and tribunals of NSW in connection with disputes concerning this Promotion.
Any terms prohibited by law shall be void without prejudice to the remaining terms.
