Item 3: Eligible Entrants
Entry into ‘Win a Summer Beach Pack, thanks to Maui Jim’ (Promotion) is free and open to Australian residents aged 18 years and over.
The Promoter, participating stores, licensees, on-sellers and their employees (and their immediate families), and their agencies / companies associated with the conduct of this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Item 4: Promotion Period
The Promotion Period begins 9.00AM (AEST) on FRIDAY 1st DECEMBER 2023 and ends 11.59PM (AEST) on WEDNESDAY 31st JANUARY 2024.
Item 5: How to Enter
To enter this Promotion, Eligible Entrants must, during the Promotion Period:
Try-on a pair of Maui Jim non-prescription sunglasses at any ‘BrightEyes’ store as witnessed by a store sales associate; and subsequently receive the promotional password from the staff member.
Scan the QR code on the Promotional materials.
Complete all required fields on the digital promotional entry form including correctly answering the promotional codeword and acknowledgment / adherence to promotional Terms & Conditions.
Successfully submit entry form.
Completing steps 1-4 above, during the Promotion Period, will result in a 1x valid Entry to win one (1) of four (4) 'Summer Beach Pack’ prizes. No entry fee is charged by the Promoter to enter the Promotion.
If an entrant purchases a pair of Maui Jim sunglasses from any BrightEyes store during the promotional period, indicates this within the digital promotional entry form along with uploading a valid copy of their purchase receipt, the entrant will also receive a bonus entry (1x valid Entry) into the promotion.
Item 6: Number of Entries Allowed
Entrants may enter multiple times provided each entry is submitted separately in accordance with the entry instructions above and below.
Limit of one (1) entry allowed for each pair of Maui Jim sunglasses purchased by the promotional entrant during the promotional period.
Item 7: Method
The winner(s) of the Promotion (Winner) will be selected at random from all valid Entries and is determined by chance. Each draw (x4 total) will take place at BrightEyes. Address: 16 Torres Crescent, North Lakes, QLD 4509, Australia, on the Draw Date and witnessed by an authorised representative.
#The Promoter may draw additional reserve Entries and record them in case an invalid Entry or ineligible Entry is drawn.
Item 8: Draw Date
THURSDAY 1st FEBRUARY 2024.
Item 9: Winners
Four (4) individual winners will be selected based on criteria established in Item #5.
Item 10: Prize
Each Winner will receive the following ‘Prize Pack’:
One (1) Maui Jim non-prescription sunglasses (valued at up to $725 RRP)
One (1) soft sided Engel Cooler (valued at $180)
One (1) Tommy Bahama Beach Chair (valued at $125)
One (1) Maui Jim beach towel (valued at $55)
One (1) Yetti Slide Tumbler (valued at $40)
One (1) Maui Jim Trucker Hat (valued at $35)
Total Prize pack is valued at up to $1,160. Collection of each ‘Prize’ will be organised between the Winner and BrightEyes Head Office or the local store in which the participant registered.
Item 11: Total Prize Pool
The Total Prize Pool is valued at up to $4,640 AUD.
The Promoter accepts no responsibility for any variation in the value of the prize.
Item 12: Publish and Notify Winner Date/s
The Winner(s) will be notified on THURSDAY 1st FEBRUARY 2024 via Email and phone. The winner(s) full name(s) will be published on the BrightEyes’ Facebook page on THURSDAY 1st FEBRUARY 2024 .
Item 13: Prize Claiming
Claiming of Prize(s) will be until 28th FEBRUARY, 2024 or 4 weeks from date winner(s) announced.
Each winner must present the following to receive the prize:
Valid Driver’s License / Government ID
Sales Receipt as proof of purchase (relevant only if bonus entry submitted)
Should either prize not be claimed by above date, the next entrants drawn# will be notified and an additional 4 weeks provided until such time as both (2) promotional prize packs have been claimed.
Item 14: Permit Number
No trade promotional permits required in relevant states (QLD / WA / NT / VIC).
Information on how to enter and the Prize form part of these Conditions of Entry. Participation in this Promotion constitutes acknowledgment and acceptance of these Conditions of Entry.
The Winner(s) agree to comply with these Conditions of Entry.
Late, incomplete, indecipherable, incorrectly submitted, corrupted, misdirected, inaudible or incomprehensible Entries will be deemed invalid and will be ineligible to win.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, technical failure, tampering, the Promoter reserves the right, in its sole and absolute discretion, and to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that entrant invalid.
Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the entrant.
The Promoter does not accept any responsibility for late, lost or misdirected Entries for this Promotion.
The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If a winning Entry is deemed not to comply with these Conditions of Entry, the Entry will be discarded and a new winner of that prize will be determined in accordance with the Method.
The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid.
Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner. The Promoter’s decision is final and no correspondence will be entered into.
If for any reason any winner does not take/redeem the Prize (or part of the Prize) by the time stipulated by the Promoter, the Prize (or that part of the Prize) will be forfeited.
Where entry is allowed by purchase or subscription, the cost of the product or service is no greater than the cost would be without the opportunity to participate in the Promotion.
Entrants must keep their proof of purchase specified in the How to Enter section for each entry as proof of purchase ("Proof of Purchase"). If an entrant fails to produce the Proof of Purchase for a specific entry or each entry, as and when requested by the Promoter, the Promoter has the right to invalidate the entrant's respective entry/entries for which Proof of Purchase cannot be provided and/or all entries submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s) must clearly specify: (a) the store of purchase as an eligible store; (b) the required product/s or service/s to be purchased for entry; and (c) that the purchase was made during the Promotional Period and prior to entry.
Prizes are not interchangeable and cannot be redeemed for cash. The Eligible Entrant acknowledges that if successful in being awarded the Prize, the Prize is subject to availability and scheduling requirements in the Promoter’s discretion. Prizes awarded are final.
If a Prize (or any part of a Prize) becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter will endeavour to provide a substitute prize of equivalent value and/or specification, subject to the written directions of any regulatory authority.
