Terms and Conditions

1.            The Promoter

CW Media PTY LTD ACN 606 548 298, ABN 43 913 252 975, 6 Albert Street Preston, Vic 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.

2.            Terms of Entry

(a)          Competition entries can be made from 00.01am AEDT on Thursday 27 June 2024 until 11.59pm AEST on Saturday 31 August 2024 (‘Competition Period’) through the relevant Promoter’s website, based on the store where the Qualifying Purchase (defined below) was made:

(b)          Entries received outside the Competition Period will not be eligible or accepted.

(c)           Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.

(d)          Entry is conditional upon buying any Wanderlust product in-store or online at Chemist Warehouse, My Chemist or E-Pharmacy (“Qualifying Purchase”) and entering via the relevant Competition website above.

(e)          Entrants must be able to provide proof of all Qualifying Purchases in the form of a valid purchase receipt number. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Competition Period but prior to entry.

(f)            The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.

(g)          Submitting an entry constitutes acceptance of these terms and conditions.

(h)          Multiple entries by eligible entrants are accepted, subject to the following conditions:

(i)            only one entry allowed per day during the Competition Period;

(ii)           each proof of purchase receipt must evidence a single transaction referred to in paragraph 2(e); and

(iii)          each entry must be submitted separately and in accordance with the entry requirements. 

3.            Who May Enter

(a)          The Competition is open to Australian permanent residents over 18 years of age.

(b)          The following are ineligible to enter:

(i)            Employees of the Promoter and Wanderlust Pty Ltd (“Prize Supplier”);

(ii)           Parties to whom the Promoter has contracted work in relation to this Competition;

(iii)          Parties who are otherwise directly involved with this Competition; and

(iv)          Any immediate family members of any of the above mentioned parties. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.            Prize

(a)          The first valid entry drawn will win a trip for two (2) adults to New York, USA valued at up to $20,000 depending on date and point of departure. Prize includes:

·         2 x return economy airfares for 2 adults from the winner’s nearest capital city to New York, USA;
·         Four (4) nights’ accommodation in a 5-star hotel with daily breakfast included;
·         Two (2) tickets to the Drew Barrymore Show; and
·         $2,000 AUD spending money (for the winner only).
 
(b)          Total prize value is up to $20,000 AUD.

 
5.            Major Prize Conditions

 
(a)          Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

(b)          Prize must be taken between January 2025 and April 2025, with dates to be advised by the Promoter upon confirmation of the filming schedule of The Drew Barrymore Show, and is subject to booking and flight availability. Tickets to The Drew Barrymore Show are subject to production schedules and availability. The winner and their companion must sign an appearance release in the form provided by the Promoter or Prize Supplier. Prize cannot be taken during Australian school holidays, public holidays or other peak periods.

(c)           The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations, and travel documentation. The winner and their companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

(d)          Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

(e)          In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

(f)            If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

(g)          The Drew Barrymore Show ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

(h)          As a condition of accepting the prize, the winner and their companion must sign any legal documentation as and in the form required by the Promoter and/or Prize Supplier in their absolute discretion, including but not limited to a legal release and indemnity form.

(i)            Big Ticket Pictures, Inc. (dba The Drew Barrymore Show) is a prize-provider only and is not a promoter of this promotion.

6.            Prize Draw

(a)          The Competition winner will be randomly selected using automated online software.

(b)          The draw will take place at 6 Albert Street, Preston VIC 3072 on Monday 2 September 2024 at 3:00pm AEST, in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

(c)           The Competition winner will be notified by SMS or email within seven (7) days of the draw and their name will be published on the below websites on Monday 2 September 2024:

(d)          If the prize is unclaimed, an unclaimed prize draw may take place on Wednesday 2 October 2024 at 10.00am AEST at 6 Albert Street, Preston VIC, 3072, subject to any direction from a regulatory authority. The winner, if any, will be notified in writing within seven (7) days of the draw and their name will be published  on the below websites on Wednesday 2 October 2024:

(e)          If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of an entrant.

(f)            Subject to the unclaimed prize draw clause, if for any reason the winner does not take/redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

7.            Privacy and use of personal information

(a)          In accordance with the Privacy Act (1988) (Cth), the Promoter collects personal information ("PI") in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. If the information is not provided, the entrant may not participate in the Competition.  The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.chemistwarehouse.com.au/aboutus/privacy.

(b)          In additional to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, use entrant’s PI, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering and for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.

(c)           Each entrant consents to the Promoter using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition. 

8.            Discontinuation of the Competition or Disqualification of an Entrant

(a)          The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants, subject to any written direction from a regulatory authority.

(b)          The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the Competition.

9.            Exclusion of Liability

(a)          Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

(b)          Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, Prize Suppliers and Big Ticket Pictures, Inc. (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way  out of this Competition, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if The Drew Barrymore Show is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking of the prize and/or attendance at the prize event.

(c)           The Promoter’s decision on all matters relating to this Competition
