TERMS AND CONDITIONS:
1. Kentucky Fried Chicken Pty Ltd ACN 000 587 780 of 20 Rodborough Road, Frenchs Forest NSW 2086, telephone 1300 749 924 is the promoter (“Promoter”) of the promotion described as the “Christmas in July Colonel’s Lodge” (“Promotion”) in the terms and conditions set out below (“Terms and Conditions”).
2. Information on how to enter the Promotion and the details of the prize forms part of the Terms and Conditions.
3. Participation in this Promotion is deemed acceptance of the Terms and Conditions.
Eligibility to Enter
4. Entry into the Promotion opens on 01/07/2024 and closes at 11:59pm AEST on 31/07/2024 (“Promotional Period”).
5. To be eligible to enter, an entrant must be an Australian resident aged 18 years or over who is able to travel and take the prize on set dates in August (if drawn as a winner).
How to Enter
6. To enter, individuals must undertake the following steps during the Promotional Period:
a) Spend $30 or more using the KFC App;
b) Once the transaction has been processed, follow the prompts that appear in the pop-up window to create an entry into the Promotion;
c) click to accept and agree to these Terms and Conditions; and
d) click to confirm that they are:
1) eligible to respond to the Promoter’s winner notification within the relevant time frame outlined in Clause 12;
2) available to travel to the prize destination as detailed in Clause 14; and
3) over 18 years of age.
By entering the Promotion, and agreeing to the above, the entrant acknowledges and agrees that the Promoter will use the contact details associated with the customer account on the KFC app attached to the applicable transaction for the purposes of the draw and winner notification where relevant.
7. An entrant may submit multiple entries to the Promotion, subject to the following:
a) only one (1) entry permitted per transaction;
b) each entry must be submitted separately and in accordance with the entry requirements as set out in these Terms and Conditions; and
c) only one (1) entry is permitted per person, per day.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thePromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
9. Incomplete or illegible entries will be deemed invalid.
10. Employees (and their immediate families) of the Promoter, its associated entities and franchisees and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant using reasonable means available to it.
Draw
12. There will be three (3) draws conducted for this Promotion (each a “Draw”). Entries open at 12:00am AEST and close at 11:59pm for each Draw on the dates specified in the table below. All Draws will take place at Anisimoff Legal, 3 Amy Close, Wyong NSW 2259 at 11:00am AEST on the dates specified in the table below. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Non-winning entries in each Draw will be entered into any subsequent Draws. Winners will be notified immediately in writing and by phone to the contact details that they used to complete their transaction within the KFC App, on the same date as the relevant Draw, as outlined in the table below, and their names (first initial, surname and postcode) will be published on the dates outlined in the table below. Drawn winners will be deemed a provisional winner subject to verification by the Promoter that all Terms and Conditions have been satisfied. Drawn winners must respond to the Promoter's winner notification by email or phone within 24 hours from the time the Promoter’s winner notification was sent to the drawn winner in order to claim their prize, should they be deemed eligible. If a drawn winner is contacted and deemed invalid or ineligible, the Promoter will revert to a reserve entry (as indicated above) and the notification process will start again. If, however, a drawn winner is unable to be contacted and/or fails to respond within the required timeframe outlined above, the Promoter will conduct an unclaimed prized draw in accordance with Clauses 20 and 21.

13. The Promoter’s decision is final and no correspondence will be entered into.
Prize and Prize Requirements
14. The first valid entry drawn in each Draw will each win a trip for up to four (4) adults to the Colonel’s Lodge, in the Blue Mountains, NSW valued at up to $10,000 depending on point of departure. Prize includes:
4x Return economy class airfares from the winner's nearest Australian capital city to Sydney, NSW (only provided if winner resides outside of NSW). If a winner is from NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Depending on the winner’s location, the Promoter may, in its absolute discretion, organise return transfers from their residential location in NSW to the Blue Mountains;
Two (2) nights accommodation in the Colonel’s Lodge; and
Full KFC Catering for the duration of the stay between 10am and 7pm. This includes any available KFC menu items, up to the total value of $2000 per day.
15. Prizes must be taken on set dates according to when the winner was drawn, as follows:
Draw 1 winner must travel to the Blue Mountains, NSW on 01/08/2024 and check in to the accommodation from 2pm. Winner must check out from the accommodation by 10am on 03/08/2024.
Draw 2 winner must travel to the Blue Mountains, NSW on 03/08/2024 and check in to the accommodation from 2pm. Winner must check out from the accommodation by 10am on 05/08/2024.
Draw 3 winner must travel to the Blue Mountains, NSW on 05/08/2024 and check in to the accommodation from 2pm. Winner must check out from the accommodation by 10am on 07/08/2024.
Spending money, meals, taxes (excluding airline and airport taxes where a winner is entitled to the airfare component of the prize), insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges, incidentals and all other ancillary costs are not included. Any damage to the property, missing items, and/or loss or damage resulting from the host and/or house rules not being complied with in full, will result in the winner being liable for all and any costs, loss and/or damage incurred during the stay. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
16. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. .
18. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize (or part of the prize) to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total prize pool value is up to $30,000. Prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. A draw for any unclaimed prizes, may take place on 24/07/2024 for Draw 1, 29/07/2024 for Draw 2 and 03/08/2024 for Draw 3 at the same time and place as the original Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified immediately in writing and by phone to the contact details attached to the relevant transaction within the KFC App, on the same date as the relevant unclaimed prize draw and their names (first initial, surname and postcode) will be published on the same date as the relevant unclaimed prize draw.
21. Any drawn winners in an unclaimed prize draw will be deemed a provisional winner subject to verification by the Promoter that all Terms and Conditions have been satisfied. Any drawn winner in an unclaimed prize draw must respond to the Promoter's winner notification by email and phone within 24 hours of the time the Promoter’s winner notification was sent to the drawn winner in order to claim their prize, should they be deemed eligible. If a drawn winner in the unclaimed prize draw is contacted and deemed invalid or ineligible or fails to respond within 24 hours of the Promoter’s notification, the Promoter will revert to a reserve entry drawn in the unclaimed prize draw.
22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
General
23. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, or any event of war, terrorism, state of emergency, pandemic or any other kind of disaster event that occurs in any destination country, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
24. Any cost associated with accessing the KFC App is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
27. As a condition of accepting the prize, a winner (and their companion(s)) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
28. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in the Kentucky Fried Chicken Pty Limited privacy policy, which can be viewed at
https://www.kfc.com.au/privacy-policy (“Privacy Policy”). In addition to any use that may be outlined in this Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
