1. “The Promoter” is The Coffee Club Franchising Company Pty Ltd ACN 128 563 333 trading as The Coffee Club, Level 13, 199 Grey Street, South Bank QLD 4101.
2. By entering this competition, you agree and are automatically deemed to have read, understood, and accepted these terms and conditions (terms).
3. If there is any inconsistency between these terms and anything else that refers to this competition, these terms will prevail.
4. A Participating Store means any The Coffee Club restaurant or café in Australia.
Participation
5. Participation is open to all Australian residents, except employees and immediate families of the Promoter and their associated companies and agencies. Immediate family includes but is not limited to; spouse, child or step-child (whether natural or by adoption), parent, step parent, grandparent, sibling, uncle, aunt, niece, nephew.
When to Enter
6. The competition commences at 12:01am (AEST) on Wednesday, 18 June 2025 and will close at 11:59pm (AEST) on Tuesday, 22 July 2025 (Competition Period).
7. The Promoter accepts no responsibility for any inability for a customer to access the competition due to technical disruptions, network congestion or for any other reason.
8. To participate, entrants must upload a photo of the applicable colouring-in page along with their submission (in accordance with clause 9(a)-(c) within the Competition Period); see details below at clause 9.
How to Enter
9. This is a game of skill where entrants are required to (Entry):
a. obtain a The Coffee Club Kids menu at any Participating Store (Menu):
b. complete the colouring page, located on the back of the Menu;
c. submit at the following link www. coffeeclub.com.au/smurfs:
i. a photo of the coloured in Menu; and
ii. your contact details (Name; phone number; home address and email address).
10. A person must not submit more than one Entry.
11. Entrants are required to take full responsibility for the content of their Entry and for ensuring that their Entry complies with these terms.
12. Any Entry that is made on behalf of a minor or that requires the assistance of a third party to enter due to a disability can be submitted by a parent or guardian.
13. The Promoter reserves the right to:
a. disqualify any participant who:
i. tampers with the Entry process (including but not limited to entrants and households who use multiple email addresses or third-party software or applications);
ii. submits an Entry that is not in accordance with these terms; or
iii. in the opinion of Promoter, engaged in conduct, which is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the competition and/or Promoter;
b. moderate, monitor, delete, or reject any or all entries submitted at its sole discretion, including removing content it considers to be incomplete, indecipherable, inappropriate, offensive, unlawful, or otherwise not in the spirit of the competition.
Draw and Notification
14. At the end of the Competition Period, all valid Entries will be judged by a judging panel located at Level 13, 199 Grey Street, South Bank QLD 4101. One (1) first prize winner (first prize winner), fifty (50) second prize winners (second prize winners) and fifty (50) third runners up (third prize winners) will be selected, at 11:00AM (AEST) on 29 July 2025.
15. The first prize winner will be notified via email, to their nominated email address and via phone call, to their phone number nominated on their entry, by the Promoter, by no later than 5:00pm (AEST) on 29 July 2025. If the first prize winner does not register their acceptance of the first prize by return email to the Promoter by 11:59pm (AEST) on 31 July 2025, the first prize winner will be deemed to have not accepted and forfeit their entitlement to the prize.
16. The second prize winners and third prize winners will be notified via email, to their nominated email address nominated on their entry, by the Promoter, by no later than 5:00pm (AEST) on 30 July 2025. If the second prize winners and third prize winners do not register their acceptance of their prize by return email to the Promoter by 11:59pm (AEST) on 2 August 2025, the second prize winners and third prize winners will be deemed to have not accepted and forfeit their entitlement to the prize.
17. A draw for any unclaimed prizes will take place at 11:00am (AEST) on 4 August 2025 at the same place and in the same method as the original draw. The substitute prize winners, if any, will be notified by email within two (2) business days of the draw and their name will be published at
www.coffeeclub.com.au from 6 August 2025 (Unclaimed Prize winners).
18. If an Unclaimed Prize winners do not register their acceptance of the prize by return email to the Promoter by 11:59pm on 8 August 2025, the Unclaimed Prize winners, if any, will be deemed to have not accepted and forfeit their entitlement to the prize. The Promoter may then dispose of such prize, at its sole discretion, and does not need to select any further prize winners.
19. The prize will be awarded to the person named in and who submitted the valid Entry.
20. Any prize draw decisions are final and binding, no correspondence will be entered into regarding the competition result, or any other decisions the Promoter makes in connection with the promotion.
21. Delivery of the prize will be made within two [2] weeks of the prize winners acknowledging acceptance of their prize in accordance with these terms, and providing a valid postal address for delivery. Failure for the prize winners to provide a correct personal information, including without limitation a correct email and postal address, may result in forfeiture of the prize.
The First Prize
22. The first prize winner will win a Family Adventure trip to the Aussie Outback in Northern Territory for four (4) people, valued between a total of AUD $7,990.00 and $12,000.00 (First prize).
23. The First prize includes:
a. return economy flights from the first prize winners nearest capital city to Uluru – to a maximum value of $6,400.00;
b. four nights in a one (1) room shared, four-star hotel accommodation – to a maximum value of $3,200.00;
c. a segway tour – valued at $1,000.00;
d. Field of Light experience – valued at $540.00; and
e. $500.00 spending money.
24. To accept the first prize, the winner must be over the age of 18 years of age.
25. The First prize must be redeemed in full by the first prize winner within 12 months of notification of winning the First prize.
26. For removal of doubt, the Promoter may disclose the contact details of the first prize winner to third party providers, including without limitation Paramount Pictures, where required. Within 45 days’ of receiving notice of winning the First prize, the first prize winner will be responsible for, and required to:
a. liaise directly with the Promoter to arrange flights, accommodation booking and Field of Light experience; and
b. to provide their bank account details for the deposit of the spending money.
27. The First prize cannot be transferred, resold, exchanged, or redeemed for cash.
28. The First prize cannot be used between the dates of 15 December 2025 to 30 January 2026, 1 April 2026 to 10 April 2026, or on public or national holidays.
29. It may be a condition of accepting the prize that the winner sign a legal release in a form determined by the Promoter in its absolute discretion.
30. The Promoter takes no responsibility if the prize is lost, stolen, damage or becomes void upon being supplied to the first prize winner.
31. The First prize winner acknowledges and agrees that:
a. all elements of this First prize are subject to availability at the time of the booking;
b. all tickets booked are non-transferable and no name changes are allowed. Once tickets have been issued, they are non-endorsable and non-transferable. Any alternations to confirmed flights and/or accommodation details will be at the expenses of the First prize winner;
c. all components of the First prize must be fulfilled at the same time and cannot be split across different time periods. Any changes by the First prize winner made to the First prize (including travel extensions, additional guests and so on) will be subject to an administration charge of $250.00 + GST to be paid in full before the booking is confirmed;
d. flights which form part of the First prize will be economy class flights and may be indirect routes. The airline, flight route and dates of travel are subject to the absolute and final decision of the Promoter; and
e. the Segway activity is an adventure activity and in order to partake in this activity each participant must weigh between 45kg -117kg (99-257 pounds).
32. All entrants agree that if they win the first prize, they will:
a. be solely responsible for liaising with the Promoter for booking travel and making travel arrangements. The first prize winner acknowledge and agree that the Promoter is not liable to assist the first prize winner with making travel arrangements in any form, or for any losses that the first prize winner may incur or suffer as a result of, or arising in connection with, the use of the prizes in any form;
b. be responsible for, and their guests will be responsible for, accepting the First prize and traveling at their own risk;
c. not sell or otherwise provide their story and/or photographs to any media or other organization, without the prior written consent of the Promoter;
d. comply with all the conditions of use of the First prize and the Promoters requirements, if any;
e. receive and take the First prize on an “as is” basis, without warranty of any kind, express or implied (including but not limited to without any implied warranty of merchantability or fitness for a particular purpose); and
f. be liable for all costs associated with the use of the First prize, including but not limited to flights, transport, parking, insurance, airport transfers, spending money and accommodation, if applicable.
33. The First prize must be taken as stated and no compensation will be payable if the first prize winner is unable to use the First prize as stated.
34. Where the First prize includes a ticket, ticket allocation (date and seating) will be at the Promoter’s sole discretion.
35. If the First prize is unavailable, for whatever reason, the Promoter reserves the right to cancel, terminate, modify, suspend or substitute the First prize for a prize of equal or greater value, subject to State or Territory legislation.

46. The Third prize is available for use at the major cinema chains of Event Cinemas, Hoyts Cinemas, Readings Cinemas, Dendy Cinemas and Palace Cinemas and is not valid on discount days, Saturdays after 5:00PM, on public holidays or at premium, large format screens, 3D sessions or special events.
47. The total prize pool value is approximately $3,000.00.
48. The Third prize cannot be transferred, resold, exchanged, or redeemed for cash.

Entrant’s Warranties
55. By partaking in the competition, entrants:
a. consent to the collection, use and or disclosure of information provided by it for internal research, and current and future competitions, advertising and marketing activities of the Promoter, its associates and its sponsors, whether in Australia or overseas;
b. agree for the Promoter and its associates to contact them and send and/or provide information via telephone, mail, in person, email, SMS and any other form of communication medium;
d. consent to, and authorises the use of, their name and image in any publicity material as determined by the Promoter at its sole discretion and/or as may be required by the relevant lottery and/or gaming legislation;
e. consent to their entry becoming the property of the Promoter pursuant to the Copyright Act 1968 (Cth) or otherwise; and
f. acknowledge and agree that the Promoter is entitled to do any of the abovementioned acts without compensation or fee, and that such consent is enduring.
Liability
56. Subject to complying with all relevant State and Territory legislation, the Promoter reserves the right to amend, cancel or suspend the competition, including but not limited to circumstances where:
a. an outside act, agent or event prevents or significantly hinders the Promoter’s ability to proceed with the competition, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, pandemic, war, act of terrorism;
b. the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failures which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition.
57. The participant acknowledges and agrees that the Promoter is not responsible or liable for:
a. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
b. unauthorised human intervention in any part of the competition;
c. electronic or human error which may occur in the administration of the competition;
d. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
e. any theft, unauthorised access or third party interference;
f. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
g. any variation in value to that stated in these terms;
h. any delay, cancellation, postponement or attendance of a Coupon, if applicable; and
i. any tax liability incurred by an entrant.
58. These conditions do not affect, and are not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the T-Shirt supplied again.
Statutory Warranties
59. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth) or any other relevant legislation which cannot be excluded, restricted, or modified.
60. Notwithstanding clause 59, to the fullest extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered, including but not limited to direct, indirect or consequential loss, or for any personal injury suffered or sustained in connection with the Coupon or competition except for any liability which cannot be excluded by law.
61. Each entrant shall indemnify the Promoter (and their respective directors, officers, employees and agents (each an “indemnified person”) for any loss, liability, cost, damage or expense suffered or incurred by any indemnified person as a result of:
c. the entrant breaching any of these terms;
d. a warranty given by the entrant proving to be untrue; or
e. any personal injury arising from or related to any wrongful or negligent act or omission by the entrant in connection with this competition.
Privacy
62. The Promoter collects personal information about the entrant for the purposes of conducting this competition. Any disclosure of such information will be made as required by law and in accordance with The Coffee Club’s Privacy Policy available at
www.coffeeclub.com.au.
63. All entries will be entered into a database and the Promoter may use the entrant’s names and email address for future competitions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
64. By entering this competition, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out on its website
www.coffeeclub.com.au. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
General
65. The Promoter may amend, cancel and/or suspend the competition at any time, without notice. If the Promoter does so, the Competition Period will automatically expire.
66. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered.
67. To the extent it is legally possible, this agreement is governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of Queensland, Australia.
