 1. This competition is for the most original or creative 25-word or less answer to the entry question “How a magicolor printer will add a touch of class to your business”. By entering into this competition, you agree to comply with the terms outlined below (Terms and Conditions).
2. The promoter is Konica Minolta Business Solutions Australia Pty Limited ABN 50 001 065 096 of 4 Drake Avenue, Macquarie Park, NSW 2113 (Promoter).
3. The competition commences on 1 February 2011 and ceases on 31 March 2011 (Eligible Period).
4. Eligible Printers include:
(a) magicolor 4750DN
(b) magicolor 5670EN/DN/DTN/DTS
(c) magicolor 7450II
(d) magicolor 8650DN
5. The competition is open to Entrants who have purchased an Eligible Printer during the Eligible Period and are permanent residents of Australia, excluding employees of the Promoter and their immediate families (Entrants).
6. The number of Entrants is unlimited. The competition will be divided into a maximum of four rounds. Each round will contain a minimum of 10 Entrants. The round that an Entrant will participate in will be determined by the date and time that the Entrant submits his or her entry - that is, the first round will be made up of the first 25 percent of entries received by the Promoter, the second round will be made up of the next 25 percent of entries received by the Promoter and similarly with respect to the third and fourth rounds. Should the Promoter receive 30 entries or fewer, only three rounds will be conducted and three prizes awarded, should the Promoter receive 20 entries or fewer, only two rounds will be conducted and two prizes awarded and so on.
7. If the Entrant is less than 18 years of age, he or she must provide the Promoter with the consent of his or her parent or guardian to these Terms and Conditions before entering and any prizes won by an Entrant below the age of 18 will be awarded to the parent or guardian.
8. To enter the competition, Entrants must register their answer at http://www.konicaminolta.com.au/touchofclass, including:
(a) Entrant's name;
(b) Entrant's contact phone number;
(c) Entrant's email address;
(d) Place of purchase
(e) Serial number of the Entrant's Eligible Printer
(f) Entrant’s answer.
9. The Promoter may contact the winning Entrants to obtain proof of purchase. Please retain all receipts or invoices for each entry.
10. The Promoter reserves the right, at any time, to disqualify any Entrant who breaches these Terms and Conditions or is not eligible to participate as an Entrant. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Entrants must not submit multiple entries for the same Eligible Printer. The Promoter will only accept one entry for each Eligible Printer purchased.
12. The Promoter will select one winner from each qualified round after the Eligible Period. Each winner will be awarded an Apple iPad (Prize).
13. The winners will be judged by the Promoter on the basis of the most original or creative answer. The Promoter's decision is final and no correspondence will be entered into regarding the result. The eligibility of the Entrants and the awarding of Prizes is solely within the discretion of the Promoter.
14. Winners will be notified by the Promoter’s choice of either email, post or telephone. The Promoter will not advise Entrants of failure to win a Prize. The Promoter is not responsible for contacting winners by any other method or for winners not receiving notification (including as a result of a change to, or incorrect supply of, an email address, postal address or telephone number).
15. Prizes are not transferrable and are not redeemable for cash. The Promoter accepts no responsibility for any variation in the Prize value. If any Prize becomes unavailable for reasons beyond the Promoter's control, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize of similar value or specification.
16. The winning Entrants must provide the Promoter with a delivery address for the Prize within 30 days of being notified that they have won the competition. If the winning Entrant fails to do so, the Promoter reserves the right to award the Prize to another Entrant. The Promoter will bear the cost of delivering the Prize; provided, however, that if the Prize remains undelivered after one attempt, the cost of any subsequent delivery attempts will be borne by the winning Entrant.
17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence), for any loss or damage whether direct, indirect or consequential, which an Entrant incurs or is liable for in connection with the competition or any Prize, including any lost, delayed, damaged, misdirected or incomplete entries or any variation in the Prize value.
18. By entering this competition, unless otherwise advised by the Entrant, each Entrant consents to the collection, retention and use of the Entrant's personal information by the Promoter. Without limitation, the Promoter may use the Entrant's personal information for future promotional, marketing and publicity purposes (without any further reference or payment or other compensation to the Entrant). Further details about how the Promoter will handle the Entrant's personal information, are set out in the Promoter’s Privacy Policy, which is available at http://www.konicaminolta.com.au.
19. All entries become the property of the Promoter upon receipt.
20. The Entrant consents to the Promoter using the Entrant's name, image or other information concerning the Entrant and its entry in any media for an unlimited period without remuneration for the purpose of promoting the competition (including any outcome).
21. For the purposes of these Terms and Conditions, Intellectual Property Rights means all intellectual property rights at any time protected throughout the world by statute or common law including copyright, trade marks (whether or not registered) and registered designs.
22. The Entrant assigns to the Promoter all of the Entrant's Intellectual Property Rights in his/her entry and the Entrant must, if required by the Promoter, do all further things necessary to assign the Entrant's Intellectual Property Rights to the Promoter.
23. The Promoter is not obliged to use, keep or exploit the Entrant's answer. The Promoter, or any party authorised by or acting on behalf of the Promoter, may do or omit to do any and all acts in relation to the Entrant's answer and in any medium, for promotional or marketing activities such as articles, posters, billboards, television, internet/intranet, radio, trade shows or any other advertising medium used by the Promoter.
24. The Entrant warrants that:
(a) the entry is an original work of the Entrant and was not, in whole or part, copied from any existing material;
(b) the use of the entry by the Promoter or any other person will not infringe the rights of any third party.
25. The Entrant consents to all and any acts or omissions in relation to the entry and which may be done by the Promoter (whether before or after the date of these Terms and Conditions) which would otherwise, without this consent, be an infringement of the Entrant's moral rights.
26. These Terms and Conditions will be construed according to the laws of New South Wales and references to times are references to the time in Sydney, New South Wales. The word ‘including’ is not a term of limitation.
