PUIG France, Société par Actions Simplifiée with a capital of €10.000.000, registered on the Nanterre Trade and Companies Register, under number 682030507, the head office of which is situated at 6, boulevard du Parc - 92523 Neuilly sur Seine Cedex,
(referred to hereafter as “Organiser”),
is organising a free prize draw with no purchase necessary called “PACORABANNE–CLUB MILLION 2012-2013” (referred to hereafter as “the Draw”) which runs between 4 December 2012 and 31 March 2013 with random draws, according to the terms and conditions described in these rules.
Any date and/or time mentioned in these rules refers to Paris time (France), the date and time entrants log on, as registered by the computer systems of Organiser and/or its technical services providers, being authoritative.
The Draw and its promotion are not managed or sponsored by the operators of “Facebook”. Therefore, the organiser releases Facebook from any liability concerning the elements of the Draw, its organisation and its promotion.
ARTICLE 2 – ACCEPTANCE OF RULES
By entering the Draw, the entrant fully accepts these rules and the principle of the Draw. Any person failing to adhere to one or more Articles of these rules will be disqualified from entering the Draw and also unable to receive any prize he/she might have won.
ARTICLE 3 - CONDITIONS OF ENTRY
Entry to this Draw is open to all persons living in Argentina,
Australia, Austria, Bahrain, Belgium, Brazil, Canada, Chile, France, Germany, Iran, Israel, Italy, Jordan, Kuwait, Lebanon, Luxemburg, Mexico, Oman, Portugal, Qatar, Russia, Saudi Arabia, South Africa, Spain, Switzerland, Syria, United Arab Emirates, United Kingdom and United States,
who have reached the statutory age of majority in their country of residence and are aged over 18 on 4 December 2012 and have Internet access and an account on the social networking site “Facebook”, excluding employees of the Organiser of the Draw, or companies of the PUIG group, or anyone who has had a direct or indirect role in devising, creating or managing the Draw, as well as direct members of their family.
An individual is identified by the first name, family name, date of birth, postal address, country of residence and e-mail address he/she provides, as well as the password he/she chooses when registering for the “MILLION” Club according to the terms mentioned in article 4 of these rules. The Organiser reserves the right to carry out any checks for the purposes of these rules.
“Entrant” as indicated above means all family members living at the same address with the same family name. If multiple entries are made from the same household, the Entrant will be disqualified from the Draw.
It is the responsibility of Entrants living in a country other than the French Republic to ensure, before entering the Draw, that these rules and entry in the Draw do not completely or partially contravene any laws applicable in its country of residence, particularly in relation to entering advertising lotteries. Residents of a country other than the French Republic entering the Draw acknowledge they have checked that all the rules and formalities specific to their country of residence comply with these rules.
ARTICLE 4 – PRINCIPLE AND TERMS OF DRAW
The Draw is divided into four missions (referred to irrespectively as a “Mission”) allowing the Entrant to try and register for up to five different random draws. It can be accessed 24 hours a day on-line on the “MILLION” Club website at the following address:

All entries are on-line only, with no other means of entry, particularly by post.
Entrants undertake to comply fully with the legislation, regulations, standard rules and ethical codes applicable and to pay particular attention to complying with the rules protecting the interests of third parties, public order and moral standards.
To this end, Entrants undertake in particular not to use the Draw as a means to distribute any elements considered provocative, vulgar, pornographic, violent, discriminatory, racist or homophobic, promoting smoking, alcohol or drugs or inciting hate, discrimination or any criminal activity.
Similarly, entrants undertake not to promote the Draw, particularly through recommendation, to any persons aged under 18 and not having reached the statutory age of majority in their country of residence on 4 December 2012.
The process for completing a Mission is as follows:

When registering, Entrants must complete and submit the designated entry form available on the Site, giving in particular their full name, date of birth, postal address, country of residence and e-mail address and choosing their password allowing them to access their private space in the “MILLION” Club.
Incorrect or incomplete information cannot be taken into account and may result in the entry being invalid. In particular, registrations with incorrect, fictional or incomplete details or details that do not comply with the provisions of these rules or that are sent after the closing date of the draw cannot be taken into account.
Each Mission is divided into Actions which the Entrant has to carry out one after the other, when they are accessible on the Site, completion of the first Action of the Mission releasing the next Action.
Details of the Actions to be completed will be revealed as they are released by the Entrant. The Actions are all completed on-line.
When the Entrant completes a Mission before the relevant “Deadline” mentioned below, he/she can register for the random draw for the prizes corresponding to the completed Mission, by clicking, before said Deadline, on the corresponding “enter” icon in his/her personal space of the “MILLION” Club.
When each random draw has taken place, the winner will be notified by e-mail as detailed in article 6.
Entrants are only authorised to complete each Mission once throughout the Draw.
Conditions for trying to register for one or more of the first four random draws
Entry for “Mission n°1” is open from 9 a.m. on 4 December 2012 to midnight on 31 March 2013.
However, to be able to enter random draw n°1 and have a chance of winning one of the prizes of Mission n°1, the Entrant must have validly completed “Mission n°” and clicked on the corresponding “Enter” icon in his/her personal space of the “MILLION” Club at the latest by midnight on 26 December 2012 (Deadline for Mission n°1).
Entry for “Mission n°2” is open from 9 a.m. on 2 January 2013 to midnight on 31 March 2013 provided that the Entrant has validly completed “Mission n°1”.
However, to be able to enter random draw n°2 and have a chance of winning one of the prizes of Mission n°2, the Entrant must have validly completed “Mission n°2” and clicked on the corresponding “Enter” icon in his/her personal space of the “MILLION” Club at the latest by midnight on 26 January 2012 (Deadline for Mission n°2).
Entry for “Mission n°3” is open from 9 a.m. on 1 February 2013 to midnight on 31 March 2013 provided that the Entrant has validly completed “Mission n°2”.
However, to be able to enter random draw n°3 and have a chance of winning one of the prizes of Mission n°3, the Entrant must have validly completed “Mission n°3” and clicked on the corresponding “Enter” icon in his/her personal space of the “MILLION” Club at the latest by midnight on 26 February 2012 (Deadline for Mission n°3).
Entry for “Mission n°4” is open from 9 a.m. on 1 March 2013 to midnight on 31 March 2013 provided that the Entrant has validly completed “Mission n°3”.
However, to be able to enter random draw n°4 and have a chance of winning one of the prizes of Mission n°4, the Entrant must have validly completed “Mission n°4” and clicked on the corresponding “Enter” icon in his/her personal space of the “MILLION” Club at the latest by midnight on 26 March 2012 (Deadline for Mission n°4).
If any Mission is completed after the “Deadline”, even correctly, the Entrant can no longer enter the random draw corresponding to this Mission. However, the entrant can obtain a “digital reward” under the terms and conditions detailed in articles 5 and 6 of these rules, try and complete the following Mission and try and register on time for the random draws that are still accessible.
Conditions for being registered for random draw n°5
Entrants will be automatically registered for random draw n°5 if they have validly completed all the Missions n°1 to n°4 by midnight on 31 March 2013 at the latest.
Condition for doubling your chances in random draw n°5:
From 2 January 2013, all Entrants can double their chances of being picked in random draw n°5 by entering the unique code of the barcode of a product of the “MILLION” range, visible on the packaging of the Organiser’s products (when they register for the “MILLION” Club or, afterwards, during the draw, in their personal space of the “MILLION” Club).
No purchase is necessary for entrants to double their chances in random draw n°5. The unique code of the barcode on products of the “MILLION” range is visible and freely readable on the outer packaging of these products offered for sale.
ARTICLE 5 – RESULTS
Digital reward
For each Mission, regardless of which random draw and for the duration of the Prize Draw, Entrants who have entered, submitted and completed all the Actions of a Mission will automatically win the “digital reward” of the corresponding Mission which they can download in their personal space of the “MILLION” Club.
The digital reward corresponding to each Mission is indicated in article 6.
Random draws
For each Mission, winners will be drawn at random from all the Entrants who have clicked, before the Deadline of the corresponding Mission, on the corresponding “enter” icon in their personal space of the “MILLION” Club, which is accessible after entering, completing and submitting all the Actions of the Mission. The number of winners and the prizes won are indicated in article 6.
For random draw n°5, the winner will be drawn at random from all the Entrants who have entered, validated and completed all the Actions of all the Missions n°1 to n°4 by midnight on 31 March 2013 at the latest. One single winner will be drawn at random and will win the prize indicated in article 6.
Random draws n°1 to n°4 will be carried out by Maître Didier RICHARD, Court Bailiff, SCP NADJAR & Associés -164, avenue Charles de Gaulle - 92200 NEUILLY SUR SEINE - FRANCE within 3 (three) weeks from the Deadline of each Mission.
Random draw n°5 will be carried out by Maître Didier RICHARD, Court Bailiff, SCP NADJAR & Associés -164, avenue Charles de Gaulle - 92200 NEUILLY SUR SEINE - FRANCE within 3 (three) weeks from the 31 March 2011.
By express agreement between the Entrants, the Organiser and the Operators, the systems and computer files of the Organiser and the Operators are authoritative until proven otherwise. The dates and times registered are those provided by the computer system of the Operators and cannot be contested by the Entrants.
For each random draw, a single prize will be awarded per winner (same name, same e-mail address, same Facebook account, same IP address). Winners authorise the Organiser to carry out all necessary checks on their identity and address.
Entrants can only be selected if they adhere to the conditions of these rules.
ARTICLE 6 - PRIZES
Digital rewards
Each digital reward has a commercial value of zero Euros (€0).
Digital reward for “Mission n°1”: 4 wallpapers.
Digital reward for “Mission n°2”: a screen saver.

Prizes of random draws
Random draw n°1:
Fifteen (15) winners will be picked for random draw n°1 (corresponding to Mission n°1). Each winner wins a prize of a product.
The products to be won in random draw n°1 are:
- 15 miniature perfume sets (each containing two 5ml bottles of “1 MILLION” perfume and two 5 ml bottles of “Lady MILLION” perfume) with a maximum commercial unit value per set of forty Euros (€40) including tax.
Random draw n°2:
Fifty five (55) winners will be picked for random draw n°2 (corresponding to Mission n°2). Each winner wins a prize of a product.
The products to be won in random draw n°2 are:
- 20 “Golden Star Lady MILLION” sets (each containing 1 eau de parfum spray (80ml) and 1 roll-on perfume (1.8g)) with a maximum commercial unit value per set of seventy Euros (€77) including tax.
- 35 “Golden Star 1 MILLION” sets (each containing 1 eau de parfum spray (100ml) and 1 travel spray (10ml)) with a maximum commercial unit value per set of sixty seven Euros (€67) including tax.
Random draw n°3:
Twenty nine (29) winners will be picked for random draw n°3 (corresponding to Mission n°3). Each winner wins a prize of a product.
The products to be won in random draw n°3 are:
- Four 80 ml “Lady MILLION” eau de parfum sprays with a maximum commercial unit value per spray of seventy seven Euros (€77) including tax.
- 10 “Lady MILLION” sets (each containing 1 eau de parfum spray (80ml) and 1 bangle) with a maximum commercial unit value per set of seventy one Euros (€71) including tax.
- 15 “1 MILLION” sets (each containing 1 eau de toilette spray and 1 MP3 player speaker) with a maximum commercial unit value per set of forty nine Euros (€49) including tax.
Random draw n°4:
Thirty (30) winners will be picked for random draw n°4 (corresponding to Mission n°4). Each winner wins a prize of a product.
The products to be won in random draw n°4 are:
- 15 “Lady MILLION King Size” body lotions (300ml) with a maximum commercial unit value per lotion of fifty two Euros (€52) including tax.
- 15 “1 MILLION King Size” shower gels (600ml) with a maximum commercial unit value per shower gel of forty seven Euros (€47) including tax.
Random draw n°5:
One (1) winner will be picked for random draw n°5.
The prize to be won is as follows:
- one (1) diamond [0.77 ct - Quality H/Si1 - Certificate HRD - 5.79 x 5.81 x 3.71 mm] with a maximum commercial unit value of 2624 euros TTC (two thousand eight hundred and twenty four Euros including tax).
Winners will be contacted by the Organiser by email. Losers will not be informed. An email will be sent requesting confirmation and winners will have a period of two (2) weeks from the time this email is sent to reply and confirm the prize and their details. Once this period has ended, the prize will not be redistributed and will be retained by the Organiser. Winners cannot under any circumstances use the fact that they did not read the e-mail requesting confirmation within the deadline to claim the prize after the two (2) week period from the date it was sent.
Winners declare they shall complete any administrative formalities specific to their country of residence required to obtain the prizes. The Organiser shall not under any circumstances be liable for such formalities and related delays which might prevent winners from benefiting from their prize.
All winners shall provide proof of their age and place of residence at the request of the Organiser. Failing such proof, their entry will be cancelled and they will not receive their prize.
Prizes will be given to winners and them only according to the information provided when registering for the Draw. Prizes will be accepted as set out in these rules. They cannot be exchanged for the cash equivalent or an alternative or returned. The Organiser cannot be asked to make any changes (dates, prize, etc) for any reason whatsoever. No financial consideration or cash equivalent can be paid in respect of any claims concerning the delivery of prizes. The Organiser reserves the option to substitute one or more prizes of a total equivalent value, with no possible claims being made in this regard.
The Organiser declines any liability for any incidents or losses of any kind that might occur as a result of the prizes awarded and/or their use (excluding manufacturer’s liability), which the winner expressly acknowledges.
ARTICLE 7 – REIMBURSEMENT OF INTERNET COSTS
All Entrants can claim reimbursement of the costs corresponding to the time spent entering the Draw on the basis of a fixed logging-on time of four (4) minutes, i.e. €0.76. Since certain Internet service providers offer users a free Internet service or an Internet package (such as via cable, ADSL or specialised link), said users are accessing the Draw Site on this basis and cannot be reimbursed, since they have entered into a contract with the Internet service provider for their use of the Internet in general and the fact that they have logged onto the site and entered the Draw has not caused them to incur any additional costs or expenditure.
If applicable, the claim for reimbursement must be sent by post to the Organiser along with bank details, proof of use of Internet services and a letter indicating the date and time of connection, at the latest 2 weeks after the closing date of the Draw, as per postmark. The postage costs incurred by the Entrant for this claim will be reimbursed on written request on the basis of the current second class rate. Only one claim for reimbursement per Entrant registered for the Draw and per envelope (same name, same postal address) is allowed. Incomplete claims will not be considered.
ARTICLE 8 – FILING OF RULES
These rules are filed with Maître Didier RICHARD, Court Bailiff, SCP NADJAR & Associés -164, avenue Charles de Gaulle - 92200 NEUILLY SUR SEINE - FRANCE, and at the head office of the Organiser and are available on the Site.
If you wish to obtain a free copy of these rules, please request this in writing by post to the address of the Organiser: PUIG FRANCE, 6 boulevard du Parc – 92523 Neuilly-sur-Seine CEDEX.
The postage costs incurred in writing to request these rules will be reimbursed on the basis of second class post on written request, along with bank details, enclosed with the request for the rules. Only one request for a copy of these rules and reimbursement of the associated postage will be considered for each Entrant.
An addendum shall be drawn up for any amendments made to these rules and shall be available on the Site and sent along with the rules to anyone requesting them.
ARTICLE 9 - LIABILITY
By entering the Draw, Entrants acknowledge and accept the features and limits of the Internet particularly concerning technical performance, response times for consulting, querying or transferring information, risks of interruption, risks related to logging-on, lack of protection of certain data from any misuse and risks of contamination by any viruses circulating on the network. The Organiser cannot be held liable, in particular, for any faults that might affect the Internet, for any configuration problems or problems related to a given browser.
The Organiser does not warrant the uninterrupted operation of the website and/or the Draw nor does it warrant that they do not contain any computing errors or that faults established will be corrected.
The Organiser cannot be held liable in the event of technical problems affecting the Draw, if the Entrants cannot manage to log onto the website of the Draw or play, if it did not receive the data relating to an Entrant’s registration for any reason whatsoever for which it cannot be held liable (for example, a problem logging on to the Internet due to any reason whatsoever in the user’s home) or if such data arrived illegible or impossible to process (for example, if the Entrant has inadequate computer hardware or software for registering) or if there are problems sending e-mails. Entrants cannot claim any compensation in this regard.
Similarly, the Organiser cannot be held liable for any material or consequential damages caused to Entrants, their computer equipment and the data stored therein, or any direct or indirect consequences that might arise from this, particularly affecting their personal, professional or commercial activities.
The Organiser prohibits any Entrant from modifying the system of the Draw by any process whatsoever, with a view in particular to changing the outcome of a game or altering the results. In this regard, the Organiser reserves the right to ensure that all Entrants have an equal chance and to protect this, particularly via legal means or any other means at its convenience.
Similarly, any attempt to use the Draw outside the unmodified Interface set up on the Site will be considered attempted fraud. In addition, the decompilation of the Draw, the use of personal script or any other method aimed at using the Draw in any way other than as stipulated in these rules will also be considered attempted fraud and will result in the elimination of the entrant from the Draw without appeal.
The Organiser reserves the right for any reason whatsoever to cancel, postpone, interrupt or extend the Draw or change all or part of the terms of these rules without incurring its liability.
ARTICLE 10 – PERSONAL INFORMATION
To enter the Draw, Entrants must provide certain personal information about them (title, name, address, e-mail, telephone number…). Entrants acknowledge they have been informed of their rights relating to the French Data Protection Act n° 78-17 of 6 January 1978 (amended) in the registration form.
Such personal information is recorded and saved in a computer file and is necessary for their entry to be considered and to determine the winners. Such information is intended for the Organiser solely for contact purposes and for awarding prizes.
However, Entrants who wish to do so can expressly authorise the Organiser to use their information for promotional purposes, by ticking the relevant box when registering on the “MILLION” Club.
In accordance with this act, Entrants have rights to access, correct and delete information about them. To exercise these rights, applicants must send an e-mail to the following address: PUIG FRANCE, 6 boulevard du Parc – 92523 Neuilly-sur-Seine CEDEX.
Entrants authorise the Organiser to carry out any checks required concerning their identity and address. Any incorrect information and multiple entries will result in the disqualification of the Entrant.
ARTICLE 11 – DECISIONS OF ORGANISERS
The Organiser reserves the option to amend these rules at any time and take any decisions it might consider useful for the purposes of the application and interpretation of the rules. The Organiser can inform Entrants accordingly by any means of their choice. The Organiser also reserves the right to change, extend, shorten, suspend or cancel the Draw, without notice, due to any event outside its control and, in particular, in the event of force majeure or accidental case. The Organiser will in particular reserve the right, if applicable, to invalidate and/or cancel all or part of the Draw if it appears that any cheating or faults have occurred in any form whatsoever, in particular any computing error in the context of entry for the Draw. In such a case, it reserves the right not to award the prize(s) to those involved in cheating and/or take proceedings before the relevant courts against the people involved in cheating. Cheating results in the immediate disqualification of the person involved.
The Organiser cannot be held liable for the above and Entrants cannot therefore claim any damages or compensation of any kind whatsoever.
ARTICLE 12 – GOVERNING LAW - DISPUTES
These rules are governed by French law, aside from its choice of law rules.
To be taken into account, any disputes relating to the Competition must be made in writing to the following address: PUIG FRANCE, 6 boulevard du Parc – 92 2523 Neuilly-sur-Seine CEDEX, at the latest thirty (30) days after the deadline for entry into the Draw as indicated in these rules.
In the event of a persistent disagreement on the application or interpretation of these rules, and failing amicable agreement, any dispute will be brought before the competent courts in accordance with the rules of the French civil proceedings code.
