Entry into Win a Sweet Re-Treat with Aeroplane Sweet Treats (The Promotion) constitutes acceptance of these Terms and Conditions.
Information on how to enter forms part of these conditions.
The Promoter is McCORMICK Foods Australia Pty Ltd, 63 Fairbank Road, Clayton South, VIC 3169, ABN 62 004 763 259 (The Promoter).
For the purposes of the Terms and Conditions, McCORMICK Foods Australia Pty Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
Entry Requirements
Entry to the Promotion is open to residents within Australia over 16 years of age. Entrants under 18 years of age need to have the consent of their parent or guardian to enter The Promotion.
Employees, their immediate families, agencies or any other entity associated with this Promotion are not eligible to enter the Promotion.
Entry to The Promotion is free.
The Promotion commences at 11:00am AEST on Monday 1st July 2013 and closes at 5:00pm AEST on Friday 27th September 2013 (The Promotion Period).
To enter the Promotion, participants must visit the Aeroplane Jelly Facebook Page (
http://www.winwithaeroplane.com) and follow the links to the promotional tab.
To go into the draw to win, the entrant must like the Aeroplane Jelly Facebook page, complete all fields. Online entrants must remain a fan (“like” the page) of the Facebook Page for the entire Entry Period. Entrants who have “unliked” the Facebook Page at the time of determination of winners will be deemed invalid.
Entrants are required to complete all required information and agree to these Terms and Conditions for the entry to be valid.
Entrants are eligible to enter only once during The Promotion Period. Additional entries can be earned by following the ‘sharing’ links as part of the entry process.
The Promotion will be judged based on chance.
Over the Promotion Period, there will be a total of fourteen (14) winners randomly drawn:
i. One (1) major winner, at the end of The Promotion Period.
ii. Thirteen (13) minor winners, at the end of each week of The Promotion Period (refer to Draw Table).
All valid entries received will be placed into a random electronic prize draw in accordance with the Draw Details and the selected entrants will each be awarded a Prize.
Vote tampering in any form is strictly forbidden. If The Promoter determines (in its sole and absolute discretion) that an entrant/s or voter/s actions are in contravention of these Terms of Entry, that entrant may be disqualified from The Promotion and some or all the entries that the entrant has submitted may be removed from the Draw. Some examples of behaviour that may result in disqualification include, but are not limited to;
i. Registering or using multiple accounts to make more than what's deemed reasonable by The Promoter;
ii. Using automated electronic systems to facilitate voting; and
iii. Encouraging or coercing entrants not to vote.
Prizes
The prize for the one (1) major winner of The Promotion is a $10,000 family holiday to the destination as chosen in their entry. The major prize will be payable to the winner through The Promoter’s selected travel agent. The remaining funds from the booking will be supplied via cheque to the winner (to constitute spending money while on the holiday). The major prize has a total retail value of $10,000 (AUD).
The minor prize for the thirteen (13) winners of the Promotion is an Aeroplane Jelly Pack, including Aeroplane Jelly products and kitchenware. Each minor prize has a total retail value of $150 (AUD).
The total prize pool is $11,950 (AUD).
Any of these prizes may not be transferred or substituted, except at the Promoter’s discretion.
The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability.
The major prize will be valid for 12 months from the date of the draw (as below).
The major prize is valid for two (2) adults and two (2) children, aged up to 11 years old. Children over 12 years old are considered adults and it will be the major prize winner’s responsibility to pay the fee difference, if applicable.
Redemption of the major prize is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including school holidays and public holidays).
All components of the major prize must be taken together and when offered or are forfeited. The major prize winner and their travel companions must travel together and depart from and return to the same departure point. The major prize winner and their travel companions may not accrue frequent flyer points. Any extension or variation of the travel and/or accommodation dates once booked will be at the cost and responsibility of the major prize winner and their travel companions. Use of the travel prize and any passes or vouchers issued as part of the travel prize may be subject to prevailing travel prize supplier terms and conditions of use. The travel prize cannot be used in conjunction with travel discounts or special offers.
The major prize winner and their travel companions are responsible for all other expenses including but not limited to taxes, surcharges, spending money, additional meals (unless specified), drinks, transfers (unless specified), transport to and from departure point, laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, items of a personal nature, in-room charges, travel insurance (if required) and all other ancillary costs.
Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
Any tax on the prizes is the responsibility of the winner. Independent financial advice should be sought by any person participating in The Promotion.
The prize will be delivered to the winner’s address as submitted in their entry.
The claiming and collection of the prize by the winners will be subject to verification checks at the absolute discretion of the Promoter.
The prize does not include the cost of travel associated outside of the Prize as stipulated above.
No compensation will be payable if the prize is unable to be taken or used as stated for any reason.
The Promoter shall not be liable for any costs associated with the prize after delivery.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.
Draw
The draws will take place at The Promoter’s office on dates as below by a representative selected by The Promoter.
The winners will be notified via telephone and email on the day of the draw occurring.
The winner of The Promotion will be published on The Aeroplane Jelly Facebook Page,
www.aeroplanejelly.com.au and in The Australian Newspaper on dates as below.
Should the Promoter not be able to make contact with the chosen winner within a three (3) month period after the winner’s entry is drawn, the winner will be deemed to have forfeited the prize.
Should item 4d come into effect, a representative of The Promoter will select the next best entry to be the winner of the competition. This draw will take place at The Promoter’s office on the dates as below.
The winner of the second chance draw will be notified via telephone and email on the day of the redraw occurring.
The Promoter’s decision is final and no correspondence will be entered into.

Entries
All entries must be original and become the property of The Promoter upon submission.
The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
When entering the Promotion, each entrant can agree to be entered into the Promoter’s database. By doing so, the information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. If the entrant has marked the “opt-in” box on the entry form, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at their address stated in the Promoter section of these conditions.
The winners name, photographs and video footage may be used for any future promotional, marketing and publicity purposes in any media worldwide.
Warranties
Each entrant warrants that the contents of their entry is original and does not infringe the intellectual property or privacy rights of any third person.
Each entrant warrants that the use or publishing of any entry will not cause The Promoter to be in breach of any third party’s intellectual property or privacy rights.
The Promoter does not take any responsibility for any costs associated with entering and/or accessing The Promotion including and not limited to internet service provider costs.
If for any reason The Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of The Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of The Promotion, The Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel The Promotion or to disqualify any individual who has tampered with the entry process.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, The Promoter may, in its absolute discretion, cancel The Promotion and/or recommence it from the start on the same conditions subject to state legislation.
If The Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, The Promoter may deem that prize winner ineligible.
Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of The Promotion, including, but not limited to, where arising out of the following:
i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
ii. any theft, unauthorised access or third party interference;
iii. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Promoters) due to any reason beyond the reasonable control of The Promoters;
iv. any variation in prize value to that stated in these Terms and Conditions of entry;
v. any tax liability incurred by the winner or entrant; and/or
vi. redemption of the prize.
