Entrants

    Entry is open to participants globally aged 13 years or over (and for those between 13 – 18, who have consent from their legal guardian.)
    Directors, officers, employees, contractors, agents or representatives of the Promoter and/or their affiliate companies, and their suppliers and retailers, as well as the immediate family of their employees (including spouse, parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households as the employees, whether related or not, are not eligible to enter in the Competition. “Immediate family members” means parents, step-parents, legal guardians, children, stepchildren, siblings, step-siblings, or spouses. “Household members” means those people who share the same residence for at least three months a year.
    Entrants must hold a minimum of one raffle ticket to be considered for this competition

Entry Procedure

Upon entering the competition the entrant must complete the entry requirements. By completing the entry requirements and entering the Competition, the Entrant agrees to the Terms defined in this document. Entrants must provide all mandatory information, including the Entrant’s [name and email address].

Raffle Determination Details

Terms & Conditions

1. The Schedule, and these Terms and Conditions (collectively, the Terms) govern the Entrant’s participation in the Competition. Participation in the Competition is deemed acceptance of these Terms.

2. Any capitalised terms used in these Terms have the meaning given in the Schedule, except where stated otherwise.

Eligibility & Entry

3. To enter the Competition, Entrants must complete the Entry Procedure during the Competition Period. Entries may only be submitted in accordance with the Entry Procedure and will not be accepted by the Promoter in any other form.

4. Entrants may enter the Competition up to the Maximum Number of Entries (if applicable).

5. Entries must be received by the Promoter during the Competition Period.

6. Incomplete and ineligible entries will be deemed invalid. Entries will also be deemed invalid if they breach these Terms as determined by the Promoter or any other content guidelines notified by the Promoter during completion of the Entrant’s completion of the Entry Procedure.

7. By participating, you agree to be fully unconditionally bound by these Terms, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Saltwater Games Pty Ltd & Aftershock PC Pty Ltd, as final and binding as it relates to the content. This Competition is subject to all applicable federal, state and local laws.

8. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant.

9. The Promoter reserves the right, at any time, to disqualify or prohibit an Entrant from competing.

10. Submissions must be entered by submitting an entry using the online form provided on this site: https://celeros.gg/celeros-custom-pc. The entry must fulfil all Promoter mandatory requirements, as specified, to be eligible to win a Reward. Entries that are not complete or do not adhere to the rules or Terms may be disqualified at the sole discretion of Saltwater Games Pty Ltd & Aftershock PC Pty Ltd.

11. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Data collection

12. The Entrant agrees that any data generated by the Entrant in relation to the Competition, except for your personal information (Data) will be owned by the Promoter upon creation. Data includes information, images, content, videos, snapshots, and time records of the Entrant’s performance in the Competition of the Community Tournament Series].

13. In consideration for the Data, the Entrant will be rewarded with the Reward if they are successful in the Competition.

14. Subject to any privacy laws, the Promoter may use the Data for its own purposes, including to: (a) run the Competition in accordance with these Terms; (b) diagnose problems with the Competition; (c) enhance and otherwise modify future competitions or events; (d) perform analytics; (e) develop and run other competitions or events; or (f) marketing or advertising its business or other competitions or events.

15. To the extent permitted by law, the Entrant will at all times be an independent contractor, provided that it will not have authority to bind the Promoter nor to incur any obligations on behalf of the Promoter.

Rewards Determination

16. The determination of the winning Entrant(s) for the Competition will be conducted in accordance with the Determination Details.

17. The Entrant is not guaranteed to win a Reward and the chance of winning is dependent on the total number of eligible entries received.

18. Where more than one Reward is available, each winning Entrant may only win one Reward as per the Terms.

19. The winning Entrant will be notified as specified in the Schedule.

20. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will conduct the Raffle Live at the Community Tournament Final [Date TBC] utilizing the Sweepwidget raffle randomiser.

21. If the Entrant objects to any or all of their name, country and winning entry being published or made available, please contact the Promoter using the contact details in the Schedule. In such circumstances, the Entrant acknowledges that the Promoter must still provide the information and winning entry to any governmental authority on request.

22. Entrants are responsible for any and all expenses incurred when entering the Competition and accessing, claiming and/or using the Reward (unless otherwise stated on the Site).

23. The judges will be competent to judge the Competition and their full names are available on request by an Entrant to the Promoter.

24. In the event that a winning Entrant’s entry is deemed or found to be invalid, the Promoter may decide on another winning entry.

Rewards

25. The Rewards are provided to you if you are successful in the Competition and as a reward for your Data being captured, stored and used by the Promoter.

26. The Rewards are specified on the Site. THE REWARDS ARE NOT TRANSFERABLE.

27. If any Reward is unavailable and the Promoter has done everything reasonable to arrange the Reward, the Promoter may, in its absolute discretion, reserve the right to substitute the Reward with a Reward of equal value and/or specification, subject to any written directions from a regulatory authority. The Promoter may substitute a Reward for a cash alternative.

28. Notwithstanding previous provisions, all Rewards in this Competition will be awarded exclusively as Celeros Custom AFTERSHOCK PC.

Claiming Rewards

29. The Reward(s) must be claimed by the Redemption Date in accordance with any claim instructions set out in the Schedule. If the winning Entrant does not claim the Reward before the Redemption Date, the Reward will be deemed to be forfeited by the Entrant and the next eligible competitor will take their place.

30. The Promoter may require the winning Entrant to provide relevant evidence in order to claim the Reward, such as proof of identity, email, JSON game files, and digital wallet address. All winning Entrants are subject to verification by the Promoter, whose decision is final.

31. The winning Entrant may be required by the Promoter to complete and return a legal release form within fourteen (14) days from the first attempted notification (unless prohibited by law). Failure to complete such form within fourteen (14) days of receipt of such request will result in forfeiture of the Reward.

32. If a winning Entrant is not of the legal age of majority in the state of residence, these documents may be required to be confirmed and signed by the winning Entrant’s parent or legal guardian, and the Reward may be awarded in the name of their parent or legal guardian who will be required to fulfil all requirements imposed on winner set forth herein.

33. The Promoter will deliver the Reward(s) as soon as reasonably practicable.

34. By entering this Competition, the Entrant irrevocably grants the Promoter, its affiliates, successors, and assigns, the universal and perpetual right to use, in any manner and for any purpose, including but not limited to advertising, promotion, and public relations, the Entrant’s name, likeness, photograph, voice, and biographical information. This right extends to modifying, adapting, translating, creating derivative works from, and distributing any materials incorporating such likenesses and information, without further consent from or payment to the Entrant. Notwithstanding the foregoing, Entrants have the option to opt out of this grant of rights. If an Entrant wishes to opt out, they must submit a written notice to the Promoter within [specify time period, e.g., 7 days] of their entry into the Competition. Upon receipt of such notice, the Promoter will exclude the Entrant’s name, likeness, photograph, voice, and biographical information from the aforementioned uses.

General

35. Contracts (Rights of Third Parties) Act 1999: Notwithstanding any other provision of these Terms, nothing in these Terms confers or is intended to confer any right to enforce any of its terms on any person who is not a party to it.

36. Privacy: Please see the Promoter’s Privacy Notice (linked in the Schedule) for more information about how the Promoter collects, stores, uses and discloses personal data.

37. Laws not excluded: Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify any legislation which cannot lawfully be excluded or limited.

38. Liability: Neither the Promoter nor the Entrant may benefit from the limitations and exclusions set out in these Terms in respect of any liability arising from its deliberate default. The restrictions on liability in these Terms apply to every liability arising under or in connection with this Agreement including liability in statute, contract, equity, tort (including negligence), misrepresentation, restitution, indemnity or otherwise. Nothing in these Terms limits any liability which cannot legally be limited, including liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession); and (d) defective products under the Consumer Protection Act 1987.

39. No limitation in respect of deliberate default and liability which cannot legally be limited, but despite anything else to the contrary, to the maximum extent permitted by law, neither the Promoter not the Entrant will be liable for any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or the exclusion of implied warranties. Some jurisdictions may not allow (or may limit) disclaimers of certain warranties, in which case the foregoing disclaimers will be enforced to the maximum extent permitted by law.

40. The Promoter (including its respective officers, employees and agents) will not be liable to an Entrant for, and the Entrant waives and releases the Promoter in respect of all liability (including but not limited to all expenses, costs, damages, claims, losses) arising in any way out of or in connection with:

    any act or omission of an Entrant;
    any breach of these Terms by the Entrant;
    any personal injury or death or property loss or damage;
    claiming the Reward;
    use of the Reward in any way;
    any theft of any Reward or unauthorized access or third-party interference in the Competition;
    any entry or Reward claim that is late, lost, altered, damaged, delayed, corrupted or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or
    any tax liability incurred by a winning Entrant, except to the extent such liability was caused or contributed to by the Promoter’s negligent act or negligent omission.

41. Force Majeure: Neither Party will be liable for any delay or failure to perform their respective obligations under this Agreement if such delay or failure is caused or contributed to by a Force Majeure Event. Force Majeure means any event or circumstance which is beyond a Party’s reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.

42. Online entries: In the event that a dispute arises as to the identity of an online Entrant, the entry will be deemed to have been submitted by the authorised account holder of the email address. The authorised account holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation that is responsible for assigning email addresses for the domain associated with the email. The Promoter may ask any Entrant to provide the Promoter with proof that such party is the authorised account holder of the email address associated with the entry.

43. Intellectual Property: All entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned. By submitting an entry and any accompanying material, the Entrant agrees to: (a) assign to the Promoter all of its intellectual property rights with full title guarantee; and (2) waive all moral rights, in and to its entry and otherwise arising in connection with the entry to which the Entrant may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

44. Legal Warning: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Site, or the information on the Site, or to otherwise undermine the legitimate operations of the Competition may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

45. Social Media: Discord, social media membership pages, applications and use of social media generally are subject to the prevailing terms and conditions of use of the platform. Unless otherwise indicated in these Terms, the Competition is in no way sponsored, endorsed or administered by, or associated with, any platform including, but not limited to, Discord, Instagram, Facebook, Twitter, Youtube, LinkedIn, and Pinterest. If an Entrant uses social media to participate in the Competition, the Entrant understands that they are providing their information to the Promoter and not to any social media platform. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other Internet users. By participating in the Competition, the Entrant releases Discord, Instagram, Facebook, Twitter, Youtube, LinkedIn, Pinterest or applicable social media site from all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs associated with the Competition.

46. Currency: Unless otherwise specified, any reference in these terms or in any advertisement related to the Competition, to currency, whether stated as 'dollars', 'USD', or symbolized as '$', is to be understood as a reference to United States Dollars (USD). Furthermore, all competition rewards, or payments will be made in USDT (Tether), a digital currency pegged to the United States Dollar.
